Trump Wil Destroy Our Freedom of Press/Speech

I hardly think a man who spent most of his business career courting bankruptcy and who finds it necessary to exaggerate his wealth by an order of magnitude "brilliant".....

Somehow he managed to convince people to screw themselves over in a manner that caused banks to throw good money after bad at him. If that's a skill, I don't want it employed by my President.

Can't imagine you'd admire anyone with an R behind their name.

No it isn't. You are free to write that any president is a bad president, no matter how much the president is offended by it.
 
I will ignore that statement. In the first place, in the US one can sue anyone for anything already. I would be opposed to opening this up even further but what Trump is saying is no different from what his opposition on the Democratic side also say. There are many who would like to have "hate" speech illegal. Hell, even Obama went to the UN and stated that "the future must not belong to those who defame the Prophet". No. It is up to the individual to seize his own future, not to government to withhold it due to free speech.

Poor imagination, then. I'd have gladly taken Huntsman over Obama, and I'd likely vote for Kaisch over Clinton. Of course, self-identified "real conservatives" label those guys "RINO" because they're blind to their own absurd extremism.

Anyway, given the number of straight-up anti-muslim bait threads you've started around DP, I'm not particularly surprised that you are defending Trump.

There are several defenses in a Libel or defamation case.

An absolute defense in ALL libel/defamation suits is "Truth." If the statement published is factually true, there is no libel.

Another defense is "Privilege." Examples include statements on the witness stand, arguments made by lawyers in the courtroom, statements of legislators speaking of the floor of the legislature.

Public figures are subject to the defense of "Opinion." People may offer opinions about public figures and their actions freely, without fear of libel/defamation actions, much like we do in this Forum.

However, public figures can still file suit under libel. In New York Times v Sullivan (1964), the SCOTUS held that a public figure must jump over an additional hurdle and prove an additional element: "actual malice". Basically that the person making the statement knew the statement to be false, or issued the statement with reckless disregard as to its truth.

So again, Trump was being bombastic. The only way he could "change the law" would be to appoint enough new Justices to SCOTUS who disagree with Sullivan, and then try to get a case before them effectively changing the interpretation. Not gonna happen.

This thread is about Trump. Not sure why you want to make it about me, but enough with the personal commentary.
 
Donald Trump has done and said many things have raised eyebrows of many Americans but there is one area that is near and dear to Americans but has somehow slightly slipped under the radar. Trump has said that he and I quote, "one of the things I’m gonna do if I win… is I’m gonna open up our libel laws so when they write purposely negative and horrible and false articles, we can sue them and win lots of money. We’re gonna open up those libel laws." To me, this would be an atrocity to America and everything we stand for as a country. Please supporters of Trump, wake up and realize the horrible things he is saying.

Liberals hate the First Amendment and Donald Trump is a liberal. Donald Trump uses threats to sue to bully people now and he simply wants more power in his threats.
