Takes nothing from the fact that when you claimed the US constitution forbids extradition of US nationals, you were talking a load of garbage.
 
To be honest it is a little bit of a reach to charge these men with the crime given that it was probably a miss as they were firing at a Ukrainian fighter/bomber.

I was shooting a sign and shot a person instead, oops, well sorry no charges because it was a miss and he was firing at a sign.

Puhlease, what nonsense, who cares who they planned to murder, they shot down and killed hundreds of people.
 
Charging is, in this whole matter, not equivalent to convicting.

No thinking person (not even the relatives of the victims) really believes that the intention existed of bringing down a civilian airliner.

It was however brought down.

What's more on trial here, and be it by the mere scrutiny of morals, is the cover-up which the Kremlin engaged in. Clearly to avoid bad publicity (failed) and to avoid culpability that leads to payment of damages.

Not much different from fleeing the scene of a roadway accident one has caused, so as to avoid accountability.

If you were shooting an armed robber, or mass shooter, and missed, hit that same innocent person, would that be cause for a criminal murder case?

Like it or not the separatists are fighting a war. They consider themselves to be on the right side of it. Much more than the soldiers of ours in Iraq. These separatists can all tell you why they are fighting. Our soldiers can't do that. Mostly because nobody knows why they are doing it.

And none of that matters due to a little thing like war crimes, shooting at a plane in the chance you might shoot an enemy plane is lunacy. They committed murder because they had ZERO knowledge about what kind of plane they would be hitting.

No. This is plain Kremlin disinformation. There was no Ukrainian plane in that area of the country at the time.

They fired without acquiring a positive identification. In other words a crap shoot. Fire and pray it is what you hope it is (a Ukraine military transport).

Manslaughter by criminal negligence (if there is such a legal definition) cannot be ruled out.

Yes. By sending the BUK (which can strike aircraft above 30,000 feet), the Kremlin intended to kill even more Ukrainian soldiers being delivered to the Donbas war zone.

They wound up killing 298 civilians from many countries, but mostly from Holland.

But realize that this is merely [rational] conjecture. No one truly knows what the Kremlin's intent was here.
