Honourable Mr Justice Giaschi ruled that Mann’s multi-million-dollar, eight-year libel suit is “dismissed with prejudice” due to Mann’s “inexcusable delay.” (see: Para. 13).

It was a defamation lawsuit that apparently the plaintiff lost interest in and after ten years of languishing in the courts...it was finally dismissed.

Doesn't Mann have to pay Ball's court costs? Pretty expensive. Also kind of a dick move to bring suit against someone, then walk away from the lawsuit and let the case languish in the court. If I were the judge, I'd consider a contempt of court charge against Mann.

Yes he DOES have to pay costs, the amount is not stated. The Judge will NOT file a contempt charge because that isn't applicable here, it is the decision based on the defendant filing for motion of dismissal of 21 March, 2019 That is what the Judge made his ruling on.

The case was dismissed and it was a Canadian court....so I really have no idea if Mann has to pay. From what I can tell, he didn't seem to really care.

Apparently, the difference of opinion between the two men has evolved into a life long feud...ala 'The Duelists.'

Dr Mann had already won the important part of the case against Frontier Centre and Ball anyway. Frontier Centre for Public Policy retracted Tim Ball's letters and apologized to Michael Mann for publishing "untrue and disparaging comments" and that "it was wrong to suggest that Michael Mann was guilty of any dishonesty concerning his 1997 and 1998 research which produced the so-called "Hockey Stick" temperature graph."



Michael E. Mann took climate change deniers to court. They apologized.

Having the case dismissed for delay probably doesn’t phase Mann too much now anyway. During that time Tim Ball had continued to build a reputation as such an old crank nutter that no one takes him seriously anyway. He rejects the theory of evolution. He even rejects the existence of the earth’s natural ‘greenhouse’ effect and the laws of physics. He rants about bizarre conspiracies and he lies about his academic credentials.

I laugh every time climate science deniers hold Ball up as a some kind of bastion of science.

Ball’s lawyers (the real ones not his friend John O’Sullivan the fake lawyer) filed a motion for dismissal based on delay, Balls advanced age and ill health and the fact that Ball is so irrelevant that no one paid attention to what he had to say anyway, so Dr Mann’s reputation wasn’t damaged.

Desmogblog isn’t a crank pseudoscience blog like PSI. They don’t reject the laws of physics like Tim Ball’s PSI blog does.

Do you also reject the earths natural ‘greenhouse’ effect and the theory of evolution like Ball?

Desmogblog doesn’t pretend to be a “science” blog like PSI. All it does is provide background information on misinformers.

And as i said before. The case re Ball wasn’t tried. It was dismissed for delay, not merit. No one won or lost. Mann already won against the publisher of Balls letters when they retracted Balls letters and gave a written apology to Mann.

You’re really bad this. You’re cluelessness is showing.

I see that Quaestio is skating all around the fact that Dr. Ball won the lawsuit, with deflections to events outside of the case. The fallacious attacks is a sign of his desperation because as usual he avoids a debate on it for cheap attacks on people.

That Judge made a bogus argument that will be challenged, it is amazing that a Judge just made a public statement about a FUTURE trial and says who is the likely winner.

This will come back to haunt her.

He didn’t win. It wasn’t tried. The case was dismissed for delay.

But in your conspiracy blog land it was the “the Science trial of the CENTURY!!?” LOL! How freakin’ lame can science denying conspiracy nutters get.

The funniest thing is your Hero Ball is an evolution denier and a greenhouse effect denier. Congratulations!
