As coronavirus cases spike in states across the country, some communities hoping to enact measures to mitigate the virus’ spread are hitting major roadblocks.

In California, which on Friday broke another record for the number of cases in a single day, Gov. Gavin Newsom mandated that masks be worn inside public spaces and in situations where staying six feet apart from others is not possible. But at least five sheriff’s departments in the state say they won’t enforce the order, in some cases citing the minor nature of the offense or a lack of resources.

That includes sheriff’s departments in Orange, Sacramento, Tulare, Fresno and Calaveras counties.

“It is each person’s responsibility to wear a face covering, and follow other recommended safeguards, in order to stop the spread of COVID-19; it is not law enforcement’s responsibility to enforce it,” O.C. Sheriff Don Barnes said earlier this week.

Isn't if amazing. We don't enforce the law when it relates to burning, looting, vandalizing and assault in the liberal cities but Newsome is worried about mask wearing! What a fool.

I dunno. I would think Shasta or Modoc or Lassen would have a higher percentage then Orange or Fresno.

Nope. Orange County is GOP territory; has been forever. I lived there for 20 years. California's central valley is also filled with primarily rural, Republican ranchers, etc. Check out where the CA House/Senate members come from.

If the sheriffs don't want to follow their oath & the law, I'd fire their asses and put the first deputy that wants a raise in charge. I wouldn't put up with this nonsense.

Sheriffs in California are elected officials. If they followed the order they would be fired, by their constituents, and rightfully so. This is an election year. They like their jobs.

If the governor can't fire them, I suspect the legislature could. Worst case, simply defund the post, as is being done across America. This is the height of law enforcement arrogance.

They can attempt to impeach them. But imagine what their appointed successor would have to put up with, especially after the BLM bull****. Thats good way to be run out of town on a rail. Nobody would take that job and enforce the mask requirement. The counties are the one that fund the office and they are NOT going to defund them. Not in those areas. They like their jobs to much.

In California, county Sheriff is a locally-elected position. Those in Red counties want to keep their jobs. They will suffer no consequence from ignoring a state mandate, but they will definitely suffer consequences if they offend the Republican voters in their county.

Say as you wish, but I bet there's a half dozen deputies that will gladly take the raise & promotion. If not, bring someone in from the outside, and give 'em more money if need be. No, I would never allow insubordination of this sort from a so-called 'lawman'. Right.

It is indeed, but alas, the state legislature has no power over local election boards. Unfortunately, it would likely take a legislative vote to bring in the National Guard, which is frankly unlikely to happen, even with a Democratic majority in the state legislature.

Regardless, If I was Newsom or the legislature I'd impeach them if I couldn't outright fire 'em. This is Trumpian nonsense, pure insubordination. I would never put up with it, if anyway possible. I don't disagree... hell, I live in a GOP-controlled county... but it is what it is, and that's my best guess as to what will happen given the insignificant (population-wise) citizenry of these areas compared to the massive overall population of California itself.

I'm not familiar with the details, but there's always a way. Either defund the position specifically, or threaten to cut-off funding to the jurisdiction authority that does the position's funding. It's really not that hard, if there's the political will.
 
Newsom isn't someone who would get into a tiff with local officials, he's usually pretty flexible

I actually agree with that which I bolded. Newsom is very flexible, and has thus far shown a willingness to work with both sides of the aisle in a Democratic state which quite frankly could easily ignore Republican concerns without political repercussion. I don't always agree with him, voted for him only because the GOP candidate was horrible, and have both agreed and disagreed with his decisions in office.

I'm certainly not in love with the guy, but as governors go, we could have done much, much worse. He's done a decent job overall.

They are following the wishes of their constituents. How is that insubordination? They are in NO way beholden to the governor in any way shape matter or form. They are THE chief law enforcement for each county of the state. They are essentially answerable to their constituents who are making their wishes very much known. It dont get much more democratic than that.
