OP hasn’t specified who held this “the military tribunal” and when, but Joe Biden isn’t actually a member of the US military and they have no jurisdiction to indict him for squat.
 
if a person commits treason he will be indicted and tried by a military tribunal!

The military has no jurisdiction to try me for a crime of any sort.
