The Michigan State Police have a high-tech mobile forensics device that can be used to extract information from cell phones belonging to motorists stopped for minor traffic violations. The American Civil Liberties Union (ACLU) of Michigan last Wednesday demanded that state officials stop stonewalling freedom of information requests for information on the program.

ACLU learned that the police had acquired the cell phone scanning devices and in August 2008 filed an official request for records on the program, including logs of how the devices were used. The state police responded by saying they would provide the information only in return for a payment of $544,680. The ACLU found the charge outrageous.

This sort of fishing is blatantly unconstitutional. There is absolutely no reason to search someone's phone during a traffic stop and should certainly require a warrant.
 
We let big brother's toe in the door and this is what's coming, better wake up people and put the F'en leash back on big brother. THE MI. State Police chief should be instantly fired if this true and charges brought forth against those who have violated the public's trust by violating their constitutional rights.

I agree if they are doing this against peoples will this is absolutely a violation of constitutional rights. Im not seeing in this article that the police are actually doing this against peoples will. I dont see any justification for the equipment or policy during any routine traffic stop. Any further info on this?
 
I remember when I worked as a Juvenile Probation officer that we searched cell phones. Of course, probationers are required to sign a form that relinquishes their 4th amendment right in exchange for not having to serve time in detention. But nowhere on that form did it grant us the right to search cell phones. I decided not to do it since I didn't feel like ending up in court for violating some kid's constitutional rights. I'm surprised these cops aren't the least bit worried that they are going to end up sued for this kind of unwarranted search and seizure.
 
What you posted about Michigan is just the tip of the iceberg. Governor Snyder of Michigan just took over Benton Harbor. The mayor and city council there, duly elected by the people of that city, no longer control it. Instead, Snyder appointed a manager to run it. This is not the way America works, but is straight out of the Soviet Union. The Republican Party has become a joke, accusing Obama of Socialism, while instituting it themselves right under our very noses. I am so glad I moved to Texas, and Michigan can kiss my ass.

This is the SAME CRAP they pull on DUI stops. They have ZERO regard for the consitution and peoples freedoms and rights. Police and law makers run over people rights constantly within the last 6 years. Warrant? Screw it. Or how about police arresting you and holding you down against your will to poke a needle in you and draw your own blood!?!? How about the State taking your assets? Done something the law makers set up to be illegal? They will take your CAR. Your HOUSE. Your very own HOUSE!!!! They can take your cash if they suspect it to be related in a crime. They can take your CASH on a traffic stop!!!!

This Country isnt home of the free. Im guessing I could go to Germany or Poland and have more freedom.

There is another article on this that says there are prosecutor and a judge standing by to write the warrants as they are requested

If they scanned my prepaid Verizon phone, I hope they enjoy all the snow pics of last December's snow fall and all the naked pictures of my dogs and cats.

Right on! These violations are perpetuating, one brick at a time. If we can stop legal Americans in Arizona on suspicion of being illegal, why not cell phones, why not your laptop or wallet or your home?
 
This will be great for law enforcement, especially if they can grab the tracking data from iPhone users. ;)
