Senator Wyden asks DHS to explain domain seizures

And, now, he's come out expressing serious concern about the recent domain name seizures done by Homeland Security's Immigration and Customs Enforcement (ICE) group. In a letter sent to Attorney General Eric Holder and ICE director John Morton (embedded below), Senator Wyden raises numerous questions, and it's clear that he thinks ICE has gone way beyond what is reasonable and legal.

DHS thinks it has the authority to seize domain names for alleged copyright infringement, without any warning, any hearing, or any appeals process. This is chilling for free speech, and is wayyyyyy outside of anything the DHS should be involved with at all.

This needs to stop. Janet Napolitano is a horrible Homeland Security secretary and should resign immediately.

It's really messed up because some of these latest domains were legal websites in the countries where they reside. You end up in a situation where a Russian citizen using a Russian ISP while physically located in Russia is unable to access a Russian website because the United States government took the domain name.

Hopefully this abuse of power will finally push the rest of the world to set up an international domain registry. They've been planning to do it for ages but it's just never been necessary because the US has never abused ICANN until recently.

Exactly.. this is the American morality police forcing its values on the rest of the world. They took down a Spanish site that was according to Spanish law 100% legal.... okay took down is a bit much.. they took the domain, but you can still access it via the IP and alternative domains.. but still.

Yep, and that's the danger of giving the government too much power. While the current government that receives that new power might not be up to no good, the government to follow--the one we have now--might take that power and go too far with it.

It's irrelevant where the new powers came from. It's only relevant that our fringe Left government is taking those powers and going too far. This is what you and other Libbos have claimed is best for our country, but now you say it's bad.

It is the Patriot Act that is the problem. Without it, the DHS could do nada, but with it, as we have seen over the last 10 years... abuse is ripe.
