Democratic plaintiffs sue to get Bernie Sanders disqualified from Florida primary

Frank Bach and George Brown, both Democrats registered in Florida, argue state law precludes a candidate not registered as a Democrat from running in the primary.

“Defendant Sanders is clearly an Independent, and is clearly not a Democrat, by his own definitions,” the lawsuit alleges. “His current ‘day job’ is as a United States Senator and he has consistently, proudly asserted his service in that role as Independent.”

Putting aside the very obvious fact that two Democrat drones are only doing this because the Democrats are trying to once again rig the election against Bernie Sanders, it's like the Democrats are trying to destroy every reason why anyone would bother with the Democratic party in the first place.

The complaint keeps saying "Florida Law" without actually specifying or citing any statutes or case law. My guess is because its unhelpful to them.

The party gets to decide its list of candidates.

(2) By November 30 of the year preceding the presidential preference primary, each political party shall submit to the Secretary of State a list of its presidential candidates to be placed on the presidential preference primary ballot or candidates entitled to have delegates appear on the presidential preference primary ballot. The Secretary of State shall prepare and publish a list of the names of the presidential candidates submitted not later than on the first Tuesday after the first Monday in December of the year preceding the presidential preference primary. The Department of State shall immediately notify each presidential candidate listed by the Secretary of State. Such notification shall be in writing, by registered mail, with return receipt requested.

If you had bothered to even read the story you posted, you would have clearly seen that this lawsuit, which deserves to go nowhere, was raised by just two men. Not by any institution affiliated with the Democratic party.

Which raises the question about why you are clearly bothered by this nothingburger story. :shrug:

They appear to be arguing that because only registered Democrats can vote in Florida's primary, therefore only registered Democrats can run in Florida's primary.

But there is no support for that supposition in the law.

To be entirely clear - the Democratic National Committee is listed as a defendant in the suit. These two guys are suing the Democratic party.

According to the Florida democrat party by laws, theres certainly lots fo room for argument...specifically in regard to party membership for delegate appointment and even declared party status with 365 days of ballot status.

But sure...some dems are pretty desperate to keep Bernie off the ballot.

For a reason.

True, but the OP made the spectacular leap from "two citizens are suing the DNC" to "the DNC is rigged against Sanders." It was paranoia, pure and simple. This story doesn't even deserve the time of day, but because we have people who are looking for conspiracy and rigging in all corners, we have to waste time and effort addressing this **** instead of actually uniting the party. Maybe that is what the OP writer wants. :shrug:

Florida Democratic Party bylaws are not enforceable through the courts, but even if they were, I don't see anything here that would prevent Bernie from being on the ballot.

Just curious if we're going to have to listen to Bernie whining about how the party he disclaims when it suits him and joins when it suits him doesn't treat him as a favorite son all the way through the election, or will it end at some point?

The lawsuit is stupid, but the bottom lie is Bernie isn't a Democrat. He's an "independent" Senator, and filed for reelection in 2024 as an independent, but it suits him to piggy back off the Democratic party infrastructure for Presidential runs, and he's doing that. It's fine with me, but you cannot be shocked that some actual Democrats don't welcome an independent as a member of the party he refuses to join other than in election years, then leaves.

Fidel Castro is Sander's hero because he provided a literacy program, just like Hitler wasn't all bad because he provided free pre-school childcare.

Actually, Sanders stated, and has stated before, that Castro is to be repudiated. What he said was that a public literacy program isn't bad merely because someone like Castro created one. A lot of right wingers want to say that anything someone like Castro or Stalin did is bad merely because they did it--which is clearly a spurious position. The fact that Cuba had a public literacy program doesn't mean that, since Cuba was also a human rights sinkhole, we should avoid a literacy program at all costs.

So, YOUR foremost thought about Adolph Hitler is that he created great social programs, just like your foremost thought about Fidel Castro is he had some great social programs, correct?
 
Bernie's nomination guarantees Trump's reelection, a GOP takeover of the House, and a 20+ seat advantage in the Senate.

Meanwhile, the Dems are going to redistrict New York to eliminate AOC's House seat.

For the sake of their party, the DNC has to take a beating in 2020 to save their party.
