In July 2014, Sharkey began forcing E.D. to have sex, once in a communal restroom where they were seen by a 7-year-old girl, and on another occasion in a room where a detainee witnessed part of the assault. Staff at the center became aware of the situation, but failed to protect E.D. from Sharkey’s assaults, court papers allege.
Instead, the center’s staff retaliated against E.D. by denying her and her son privileges and instituting a restrictive clothing policy that caused other detainees to shun her. When Sharkey’s conduct was investigated, E.D. initially denied sexual contact because she feared deportation. She ultimately reported the assaults when she was appointed an immigration lawyer, court papers say.
In his deposition, Sharkey testified that his sexual contact with E.D. was “a joke” among staff members in their daily meetings and that one staff member texted a photo of E.D. in her underwear to Sharkey while he was on vacation.“
