A federal appeals court on Friday revived a lawsuit against Fox News brought by the parents of slain Democratic National Committee staffer Seth Rich, concluding there are plausible claims that the conservative cable network was party to a “campaign of emotional torture.”

The story in question, authored by Fox News staffer Malia Zimmerman, gave mainstream prominence to one of the most insidious conspiracy theories to arise out of the 2016 election. Suggesting that Rich’s death was a political assassination, it was promoted at various times by WikiLeaks founder Julian Assange, President Trump’s longtime political adviser Roger Stone and then White House senior adviser Steve Bannon.

I hope this comes to back to bite Faux Noose in the butt.
 
That they used Seth Rich to further their enrichment and CT BS is a bridge too far. They have no decency as well as those who spew this crap. His family has suffered enough.
 

Far ranging implications for a lot of people if such a case were to prevail.
The fallout would be enormous.
Still, if our news networks are screwing with us, that is a very bad thing.
They always have to a much lesser extent, until profit became a central tenet of newsgathering.
Suddenly it was no longer a public service, it was a profit oriented business.

If news is a consumer product, it is important to know if such products have defects.

That is all true,

However, there is no evidence that the Fox audience cares whether they are being told the truth.

Fox runs discredited stories, stories picked up from trashy right wing blogs, never fact checks anything.

When they get caught out, which is a daily occurrence, they don’t correct the record.

When the audience finds out it has been lied to, they tune in tomorrow for more fo the same.

That FOX is a propaganda organ is very old news indeed. The all the MSM is propaganda and misinformation sources is very old news indeed. Operation Mockingbird thrives.

But none of that has anything to do with the truth regarding the death of Seth Rich.

It was a cooked up right wing conspiracy theory, for which there is no evidence.

But Fox, and the rest of the right wing noise machine periodically tries to rev it up, even though it has been long since discredited.

They know their audiences like this stuff, so they keep selling it. They know their audience won’t desert them for telling them lies, but they will if they bore them.

Libel and defamation are not frivolous lawsuits. If Fox News broadcast a false story that led to actual damages to a non-public figure, then they should be forced to compensate the aggrieved parties and should be fined punitive damages for reporting a damaging false story as though it were true.

Fox's obvious and only defense will be that Seth Rich was already public figure. His estate will argue that the publicity surrounding Seth Rich was a result of Fox News' (or others') false reporting. Seth Rich was not a politician or an office holder: He was merely an employee of the DNC. All news organizations must understand the difference between a public figure who was public before they reported on him, and a public figure who became a public figure due to their reporting on him. In the latter case, libel and defamation apply. Fox News (and anyone else who perpetuated the story) deserves the maximum penalty for this.

A fair point. For any news organization to cover non public figures is dangerous and they should be careful to get their facts right.
 
This will bite every network's ass, if FNC loses.
I am sorta rooting for them to lose for that very reason. Setting this precedent will elevate the standards these orgsnazations must follow.

There is actually a fair amount of circumstantial evidence for it.

He did work for the DNC and he was found dead. Julian Assange by innuendo suggested it was him. He was very clear that his source was not a state player, it was not Russia.

William Binney and other experts pointed out the material was not hacked at all, it was leaked by somebody on the inside.

Apparently there is anecdotal evidence that Rich was angry about the way Bernie was taken out by the DNC, suggesting he had motive.
