Appeals court rules Trump can't block people on Twitter | TheHill

The Second Circuit Court of Appeals on Tuesday ruled that President Trump cannot block Twitter users from his official account, finding that the practice is discriminatory.

The ruling upholds a lower court ruling that also found Trump cannot block the Twitter users.

The president uses his Twitter account to make announcements, from personnel changes within his administration to the implementation of new policies.

The judges wrote "that the First Amendment does not permit a public official who utilizes a social media account for all manner of official purposes to exclude persons from an otherwise‐open online dialogue because they expressed views with which the official disagrees."

I heard someone else comment and thought it was an interesting point.. So, is Twitter banning someone from their service preventing that banned individual from interacting with a public official? According to the appeals court judges.. I guess not yet... but it seems problematic.
 
Did Congress pass a law that Trump signed banning Twitter users.
 
Personally, I have no need for Twitter or Facebook and I don't use Google anymore.
But don't all three censor certain users of their platforms ... in the case of Google it censors what users get to see.

Practicing WHATABOUTISM by dragging the social media companies into the argument is the height of ignorance because in the case of Google, Twitter et al, they are companies who are practicing their right to exclude people who violate their clearly written Terms of Service, which people agree to when they sign up to USE the services.

President Trump blocking people he doesn't agree with is another matter entirely because Trump is NOT a private citizen, he's the POTUS and when using his Twitter account AS POTUS, he is disseminating OFFICIAL POTUS COMMUNICATIONS, IN an official capacity AS AN elected OFFICIAL

It is OFFICAL government communications, and the government isn't allowed to discriminate or block anybody.
The moment he gives up the Office of the President, and goes back to being a private citizen, he can block a million people per hour and Twitter won't do a damn thing about it and the courts won't give a rat's ass about who he blocks either.

i don't agree with the decision. additionally, i think that he should have been banned from Twitter for threats.

Pretty sure if you break ToS you'll be banned from anyone.

No.

There's no complication or problem involving private citizens being banned. They can write a letter or watch news.

It's only a problem for the President because he uses the account as a means of office.

Twitter has not been nationalized. The President has been rebuked.

Since his administration has declared his Twitter account to be official communication, I understand the reasoning behind the decision. He should have used the @POTUS account for official tweets, and just used his personal account for his daily blatherings.

I wonder what will happen after he leaves office, if there will be any lasting impact from this ruling.

When I saw, "what about users that get banned", I thought, "no way, Chavez, that ain't happening".
 
Suspect it has to do with political speech as being at the core of the 1st, but haven't bothered to look .

I would think that when he's once again a private citizen he block anyone he wants.

Well I think future Presidents may use an official @POTUS and keep their own separate.

But after Trump leaves office, I'm sure he'll be free to block people he wants. But any public servant that will use their personal twitter account as part of their official duties as said servant will likely be unable to block people.

Regardless, the order said it was to burdensome for someone to have get around the president's block to interact with the President and his "public forum". A letter is even more burdensome (and costs a stamp) and watching the news is not providing the ability to interact with the president and his "public forum".

Having a private company get in the way of a citizen's ability to see, retweet and otherwise interact with that public forum is going to be a problem. I believe this ruling is going to be used in ways that people that hate Trump just aren't seeing yet. Time will tell.
