Fact is she had classified data on an unsecure mail server at her home.
This is a violation of every rule there is. Even when she was warned about it she continued to have classified data on that server.

We have a equal justice clause in our constitution for a reason.

It states that the law is applied equally to everyone no matter who they are.
yet in this case it wasn't.

it is clear that clinton violated more than one federal rule regarding classified information and the destruction of government records.
all things that anyone else (just like this salior) would have gone to jail over.

yet she was given a pass and if you weren't such a partisan hack you would already know this to be true.

By comparison, this is far from frivilous. This falls under "redress of grievences".

they were the ones that setup the bogus investigation to begin with.

once the IG report is released it is going to make them all look even worse.

So why is clinton above the law?

What's Obama got to do with this? The guy was convicted in a court-martial, wasn't he? And rightly so, from the report. He was guilty. It's his own damned fault he went to jail, right?

Okay, so this Sailor and I are even the same rate, went through the same schooling, know the same rules. There is no doubt about this. It is not the same thing. While I would agree that he should have probably been charged by the Navy, he likely would have faced more time, given what he did. He didn't just take photos of innocent, unclassified areas. Some of the photos were of inside the reactor compartment and maneuvering, two highly restricted areas and a propulsion panel (which would be hard to hide the classified things on). We can't even have camera phones inside the shipyard because of incidents like this, because people do stupid things like this guy did, and some for not good reasons.

And he destroyed evidence of whether or not he had shared those photos. He threw away the phone the photos were on in a very unsecure way (not sure why he would do that).

While he may not have deserved so much punishment (which was actually on the low end of what he could have gotten), he doesn't have much of a case of unfair treatment here.

That'd be up to the court-martial, right? This has nothing to do with Obama. It's the Navy prosecuting a sailor who broke the rules.

I agree, but don't think that is the point, he was treated unfairly being HC did at least as bad and was not punished in the least, that is his argument.

No, he actually was prosecuted in federal court, not court-martialed (although he could have technically had both happen to him, since there are crimes that could have been only charged under UCMJ which he could have faced in addition to federal charges over the photos of classified materials/places).
