Former Navy sailor pardoned by Trump plans to sue Obama

Just a thought, if Repubs really want to prosecute Clinton for the email/server issue then are they prepared to do the same for trump since he is constantly using even less secure devices? Be careful what you wish for, you just might get it.
 
Not expecting this to end well, at all. I am curious how much the Obama administration took a direct role / direct interest in the disposition of the former navy sailor case.

At the same time we cannot ignore all the security protocols being on a submarine like that.

Well, his lawsuit will not be claiming that he isn't guilty of the crime, it is that the government is guilty of applying the law unevenly.

It would be a really weird case if he plans on suing for damages since in order to sue for damages he would have to be aggrieved. But for him to be the aggrieved party he'd have to argue that Hillary's treatment was how the law should have been applied to him.

If he is arguing that Hillary should have been treated like he was then I don't think he'd have standing in a lawsuit.

A former Navy sailor who was pardoned by President Trump is planning to sue former President Barack Obama and other members of his administration for subjecting him to what he calls unequal protection under the law.

A lawyer for Kristian Saucier, who was pardoned by Trump in March, told Fox News on Monday that he plans to file a lawsuit accusing Obama, former FBI Director James Comey, the Justice Department and others of improperly handling the former sailor's case.

Saucier, who served one year in prison for mishandling classified information by taking photos onboard a nuclear submarine, alleges that Obama administration officials treated his case differently than how they handled Hillary Clinton’s use of a private email server while serving as secretary of State.

Two wrongs do make what this sailor did right. He is a dumbass, any E! knows not to take photos of a military installation.
 
How about this principle, "innocent until proven guilty"? And under American law, that means proven in a court of law. So in order for him to prevail, he would have to show that Clinton was found guilty, not simply "presumed". Now, if President Trump was able to gain a conviction of her, then it could be said she was guilty. However, at that point, this Sailor would not have any case because she would then have been punished for a similar crime (in likely a much more serious way).

Not true. If this were true, then everyone who has ever been pulled over for speeding when others were doing it around them could get out of the ticket by simply showing that those others were not pulled over as well for speeding, that their offense was not addressed. Most cop cars have dash cams now afterall, so those could be brought in to show inconsistent enforcement of speed laws (and I can tell you that a lot of people speed, but few are pulled over, even when police are in the area, waiting to catch speeders).

There are different circumstances of both cases, and even more differences between his and and the cases of his fellow Sailors he mentioned.

Additionally, whether we like it or not, there is a higher standard for military personnel than for civilians. This is easily seen by just the fact that we are held to the UCMJ as well as civilian laws, and we must sign a lot of paperwork related to security of classified material and areas.
 
Does anyone saying he has a case even know how or when his investigation started? I'll give you a clue, it was before the Clinton investigation and was different in nature.

I'm saying Trump got wind of the story, saw that it revolved around a perceived double standard involving HILLARY, and that he most likely stopped right there and made the decision. It is clear to anyone, even a supporter, that one of Trump's core goals is revenge against Hillary and revenge against Obama. Trump has written extensively on his love of revenge, too.
It is one of the most satisfying things he does in life and in business, according to his own books.

How? She has not been charged, and just because the Sailor filed a lawsuit, it does not mean he will prevail (in fact, it is highly likely he won't).

How is that revenge? He was pardoned after he had already served his year in jail. His other than honorable discharge is still (deservedly) on his record. This doesn't really mean a whole lot.
