No, I'm excusing this behavior because the people at the cheesecake factory have a right not to like his hat, and tell him he's an idiot for wearing it. That's them expressing their freedom of speech.

Wearing a MAGA hat is insulting to the people in this factory, and therefore they have every reason to want to insult the wearer of that hat in return.

Dont do things that might intentionally antagonize minimum wage employees fixing your food.

The Yankees are a sports team. They cannot pass legislation that would directly harm Mets fans. There would likely be less leeway there, but still, it would likely not meet the bar for incitement depending on the situation.

In this incident, yes, of course, I agree. I was talking more about root cause for the entire climate. You guys changed when he took office. And not for the better. And you've been getting worse ever since. I don't say that to be harsh, man...it's very sad to watch. And the first way to invalidate oneself is to suggest that one side or the other are entirely to blame....

It could be argued that this has been building for a long time, kind of a like a drunk who started a few years ago having a beer after work, and is up to a case of night. Maybe you guys had problems before, but electing Trump was where you guys said "**** it, I don't need to try to deny it anymore, I'm a drunk, pass me the whiskey, and I mean the bottle". And I'm not talking specifically about racism or corrupt capitalism, or war hawking, or SJWing out past the point of reasonability, or any specific thing, I'm saying all of it.

All of which I mean respectfully in return...sorry, I have a sparring writing style, and it's hard to turn it off...hopefully you appreciate not beating around the bush...hehe

You are obviously confused... EMPLOYEES do not have the right to harass, taunt, make racial slurs toward any patron of a dining establishment because they refuse to tolerate the patron's hat.
I hope he sues the pants off of this particular restaurant.

First, this was a private business, not a public street.

Second, by this definition wearing the MAGA hat in and of itself could be construed as incitement.

Third, making someone feel unwelcome and want to leave is not the same as coaxing them into punching you.

Fourth, this is a New Hampshire law, not a federal law.

Fifth, in the case you have cited the offending individual, was persistent in his attacks to the point of causing a potential riot or violent confrontation.
