Jared Kushner Registered To Vote As a Woman

If I call someone a "retard", you can call that insensitive. Right? That's fair. Maybe there's someone here who is close to a developmentally disabled person and it bothers them to see a related label used as an insult. Ok, fair enough.

But if I call someone a "retard" simply because they said something stupid, that is not some expression of animus towards mentally handicapped people or whatever I'm supposed to call them. It's only animus towards the person I'm insulting, and general insensitivity towards the mentally handicapped.

He might have made a typo. The people transcribing the information he supplied might have made a typo.

Does not matter.. it is defined as voter fraud and is punishable. Of course it is an error, like most voter fraud allegations, but it is still voter fraud.

If if we're going to play the hypocrisy game, one can always note a related strain the other way: people who previously crusaded against "political correctness" being offended by people making insensitive jokes about Kushner over this stupid meaningless data entry mistake.

I for one think it is great the Presidents daughter and her wife play such an important part in this presidents administration. It must be hard however to be TG all the time for Mrs Kushner

Especially hard given how Trump's base feels about trans people.

That's a general statement. More specifically here Federal law requires you have to "knowingly and willfully" give false information as to your "name, address or period of residence" to be guilty of voter fraud. The matches the general definition of fraud. That is inadvertent errors don't count.

As well the law doesn't even speak to gender so even if he lied about his gender on the form it still doesn't constitute voter fraud, though there may be other laws that would apply to lying on a federal form.

Now that you've had your fun, let some intelligence in. This is what the actual legal registration form looks like. Whoever transferred the information made a mistake. Or that is fake to begin with.

42 USC 1973i of the United States Code:

(c) False information in registering or voting; penalties
Whoever knowingly or willfully gives false information as to his name, address or period of residence in the voting district for the purpose of establishing his eligibility to register or vote, or conspires with another individual for the purpose of encouraging his false registration to vote or illegal voting, or pays or offers to pay or accepts payment either for registration to vote or for voting shall be fined not more than $10,000 or imprisoned not more than five years, or both: Provided, however, That this provision shall be applicable only to general, special, or primary elections held solely or in part for the purpose of selecting or electing any candidate for the office of President, Vice President, presidential elector, Member of the United States Senate, Member of the United States House of Representatives, Delegate from the District of Columbia, Guam, or the Virgin Islands, or Resident Commissioner of the Commonwealth of Puerto Rico.

The Federal law matters because it's what counts in Federal elections.


I didn't check NY law - and yes I really do live in NY, in Suffolk County on the north shore of Long Island - because I was certain it wouldn't differ from the Federal law and guess what? It doesn't.

A quick check turned up that what you referenced is what's printed on NY voter registration forms and not an actual law. The actual law that seems to apply here is Part 3 Title K S 175.30 - 35 of the NY Penal Law:

175.30 Offering a false instrument for filing in the second degree.
A person is guilty of offering a false instrument for filing in the
second degree when, knowing that a written instrument contains a false
statement or false information, he offers or presents it to a public
office or public servant with the knowledge or belief that it will be
filed with, registered or recorded in or otherwise become a part of the
records of such public office or public servant.
Offering a false instrument for filing in the second degree
is a class A misdemeanor.

S175.35 Offering a false instrument for filing in the first degree.
A person is guilty of offering a false instrument for filing in the
first degree when:
1. knowing that a written instrument contains a false statement or
false information, and with intent to defraud the state or any political
subdivision, public authority or public benefit corporation of the
state, he or she offers or presents it to a public office, public
servant, public authority or public benefit corporation with the
knowledge or belief that it will be filed with, registered or recorded
in or otherwise become a part of the records of such public office,
public servant, public authority or public benefit corporation

You have to knowing give false information.

A lie is only a lie of you do it on purpose. Mistakes don't count. Same with fraud, including voter fraud.

NP. Where abouts? I'm in Huntington, though both Mrs. Gaius and I grew up in Queens. Been out here since 1994.

Well howdy neighbor! Grew up in Northport. Lived in Huntington for a short while as well. My sister still lives there and I try to visit at least every other month.
 
It's funny to see the same people that defend a persons right to call themselves whatever they want suddenly condemn and mock Kushner for the this regardless if it was intentional or a simple mistake. I am quite frankly amazed at all the hypocrisy that has been exposed since Trump was elected. On that point at least I thank Trump.

He/she has every right to see him/herself as he/she wants. It's not their fault the the form only offers a binary choice.

Howdy! Northport Village is gorgeous. Don't get up that way much, though we try to get to Crab Meadow a couple of times during the summer and eat at La Casa.
