Yes, it means that if I hate you and kill you because you're sleeping with my wife, then there's one set of sentence guidelines the courts will use. If I hate you because you're a protected class, then the courts will use an enhanced sentence where I will go to prison longer because of the reason that I hated you. I think that's a bit absurd.

Your response here shows you ain't got the foggiest notion in regards to the legal definition of "hate crime" - not unexpected.

"The Civil Rights Act of 1968 enacted 18 U.S.C. § 245(b)(2), which permits federal prosecution of anyone who "willingly injures, intimidates or interferes with another person, or attempts to do so, by force because of the other person's race, color, religion or national origin"

The Violent Crime Control and Law Enforcement Act, enacted in 28 U.S.C. § 994 note Sec. 280003, requires the United States Sentencing Commission to increase the penalties for hate crimes committed on the basis of the actual or perceived race, color, religion, national origin, ethnicity, or gender of any person. In 1995, the Sentencing Commission implemented these guidelines, which only apply to federal crimes.

Clearly you do not understand the implication of a hate crime.:shock:

It is targeting a particular group in order to induce fear in that group. Akin to terrorism.

Zero chance.

You're right, I suspect there is zero chance that he will be charged with a hate crime. That's because it doesn't qualify as a hate crime, unless you have a link that shows something that the Daily Mail doesn't. There's no indication that he attacked the German man because of his color, or because he was gay, or something else that falls under the definition as the motive of a hate crime. Can you provide a link please?
 
Yes, we assumed that because that Negro had plenty of other Negroes to attack to impress his gf. Yet, he chose a white guy because it was an easier target - like not packing - and with less risk of getting his skull broken by the victim's 'hood buddies.

That makes this, by definition, a race-based crime. Hence, hate crime.

Absolutly nothing true or accurate in the post according to the law or common sense.
