Why would I stop mentioning that? It is part of the facts involving this case. I don't care if you don't think it matters. It's the reason WHY the asshole poured boiling hot water on them in the first place!



What do you propose he should've gotten? A slap on the wrist?

People get lower sentences for murder, 40 years is excessive no matter how you slice it, you might as well hang him because 40 years is a die in prison sentence in nearly all cases

Funny, I alway's thought always thought conservatives were supposed to be tough on crime. You sound just like a bleeding heart liberal.

So if you are suggesting folks get 40 years for a scalding, they should get 50 yrs for stabbing? and 60 yrs for shooting somebody? (even if they don't die), I am with you hommie. But in the real, non-hatecrime PC world, that ain't reality.

The sentence needs to fit to crime, and way too often in America now they dont.

Medically induced comas are used for brain injuries, not burn victims. So no, you did NOT make an "educated guess", you made it up completely. Medically Induced Coma and Sedation

C'mon. Obviously, the harmful intention is there either way. I wondered if the motive for the harmful intention should affect the sentence.

Very highly unlikely, in these kinds of cases patients are placed in medical coma so as to make treating them easier, there was always a very slim chance of dying.

I could be wrong, but that is highly unlikely.

Gay had nothing to do with it, as I said, it was handing out 40 years (I think 36 of them must be served) for a boiling water burning....that be :screwy

I've seen stories of where they induced coma's for burn victims. Not uncommon.

This guy should be charged with attempted murder. Fortunately the person did not die. If he did it would have been upgraded to murder.

In the US? Hell, there's probably guys serving 40 year sentences for marijuana charges. But I was asking if the motive for the crime should be considered when the sentence is pronounced.

I watched a guy who had two state felonies for narcotics (where he served less than 2 years total) get a LIFE SENTENCE for attempted (his mule was caught before the defendant got the drugs) possession of a couple kilos of cocaine. Fortunately Obama commuted his sentence after he served 20 years (which was way too long IMHO). A guy got A life sentence for passing three bad checks with a total value of under 300 dollars. (its a famous case that every law student encounters)

so whining that a guy who wanted to impose extreme pain on two other people for incredibly disgusting reasons got 40 years really doesn't cut it with me.

and based on tons of sentences I have seen-often involving drug trafficking or theft that resulted in more time, what this asshole got was about right. of course the best result would have been one of the victims or another citizen pulling a weapon and killing the attacker-that would have been ideal.

Damn straight.I always been tough on crime.A drunk driver killed my first wife and only got a years probation and a suspended licence.My daughters were without a mother for 5 years until I remarried.

Feel free to stop mentioning that they are gay, because so far as I am concerned that does not matter, hate crime laws are unconstitutional, are an abuse of law, only we cant get a competence Supreme Court to say so.

I am not going to research sentences for burning, but I am confident that 40 years for burning one or two people rarely to never happens.

For a reason, it is way too heavy a sentence for the crime.

Oh boo hoo, i'm sure you'd gladly volunteer to take the assault on their behalf, so trivial is it

Oh wait, you'd never have to suffer their fate, as the only reason they were attacked in cold blood is because they were a gay couple. So while you sit here pontificating on the merits of hate crime laws, you may want to consider the very last person anyone should listen to about the need to protect vulnerable citizens is the hetero white man!!

No one is serving 40 years for marijuana charges.

Maybe if they were dealing MJ by the ton or had repeated dealing / manufacturing charges, but you'd have to be a really bad grass dealer to get that kind of sentence

sorry about your loss. I cannot even imagine the rage and hatred I would feel if that happened to me. and I have no idea what the proper punishment is for someone who gets drunk and then causes a fatal wreck. I know friends of mine, even family members, who had one too many drinks at a party and got busted for DUI and I know people killed by impaired drivers. One of my former law colleague's wife and another biker were killed when a guy flying on cocaine went 65 MPH over a narrow bridge where a pack of cyclists were riding. Another guy-with 4-5 DUIs killed a guy I went to school with, a teacher, when he was riding near his home. both of the perpetrators had had numerous convictions for driving while drunk or stoned. both of them got serious jail time (10 or so years).

So I don't know what the answer is and I hope you have recovered from such a tragic loss

The problem with the g-damn law is intent. That miserable ahole to stole the life of your wife, kids and you, gets off with such a disgraceful light sentence, because he got drunk but did not intend to harm. But on the other hand, a man that was hateful, but did not want to cause permanent harm (or he would have used a gun) gets 40 years. it just does not balance.

It took me 5 years to even date another woman. Me and my second wife Selena celebreated our 15th anniversery this past June.
Spent it in Aruba.
