All right, you get that on a technicality because I never excluded little kids. It takes a whole lot less to kill them then almost full grown men though. I remain skeptical that one home kitchen pot of boiling water has ever killed an adult, or almost adult, though the shock could in theory.

Burns get infected all the time, particularly if you have two people touching each other when they get burned, since this can easily burst blisters that immediately develop with 3rd degree burns.

Burn treatment has come a long way, I dont know that the "infection might kill them" argument floats anymore, but it might.

Considering that we have new staph infections that are practically unbeatable, I'd say its a valid consideration.

Then there is the lifetime of scarring that burn victims face.

The idea that infection justifies an attempted murder charge does not work for me in any case, for one thing because 70,000 people die each year from infections they get WHILE IN THE HOSPITAL. Are we to look into murder charges for docs who refuse to wash their hands?

Disfigurement is not death. Disfigurement of the face is a big deal dont get me wrong, but I cant get to 40 years for disfigurement, I only got to 15.

I conclude that this sentence was way too harsh, and I conclude that it was driven by emotion which I never approve of because that is the road to injustice. THis is one mans opinion. Others clearly disagree. THis is OK. But we should be able to talk about it without hostility, without labelling those who hold differing and possibly minority opinions being deemed defectives. Ideas and arguments are often defective, the people who give voice to them are however almost always either just wrong or are low on arguing skills, they are not defective as people.

Do you think what the guy did to the two others guys was OK? if not, what is an acceptable punishment?

Your avatar is the CIB. If you've actually earned that CIB, and I'm not saying you didn't, then you've seen or should have seen what 3rd degree burns across a large portion of the body can do to a body, up to and including causing the person to die from sepsis - a deadly infection.

and based on tons of sentences I have seen-often involving drug trafficking or theft that resulted in more time, what this asshole got was about right. of course the best result would have been one of the victims or another citizen pulling a weapon and killing the attacker-that would have been ideal.

Are you making a case where even more egregious punitive sentences are handed out should be the metric we compare actual justice to?

However, I'm questioning the notion that the risk of wound infection constitutes attempted murder.

The fact that a person can die from burns received from a hot water heater being turned up to much, let alone actually having boiling water (which was a method of execution in the past) should be enough.

The story itself says the boyfriend did, but I can't imagine they'd induce a coma for less than third degree burns for the son.

The person that perpetrated this act, did so with the full knowledge that such an action could cause deadly consequences. With full knowledge that death was possible, to choose to act anyway, is attempted murder from a legal standpoint.

Let's say I want to hurt you, so I shoot you in the leg, but the bullet hits your femoral artery and you bleed out and die within 3 minutes. It's murder. If you don't die, it's attempted murder.

If I get drunk or even if I'm sober and just get pissed off at you and run over you with my F-350 and your head explodes under the weight of the truck on the tire that goes over your head, it's murder. If you survive, then it's attempted murder.

If the guy in this story that was near death had died, it would have been murder. He survived as did his friend, thank goodness - it's attempted murder.

40 years for burning one? person is abuse.

That's not abuse. That is felony assault with intent to kill or do great bodily harm. The good news is that he will learn what assault is when Bubba the Butt Bandit takes his virginity in prison. That's gonna be a mighty stiff sentence for him. LOL.

I showed him no compassion in this case. It is merely a position against endorsement of the state not doing it's job. When people are in the custody of the state no matter if they are a man, woman, or child the state has the duty to keep them safe from harm. When it comes to male prison society has decided that it is best if it is violent to punish those assholes that go there. Allowing prisons to be a violent institution not only shines badly on the government and the United States as a whole, but actually makes society less safe as it will lead to more mental illness and greater probability that these individuals will commit more crime when they get out.

Yes, I agree, the state does have a responsibility to protect them. But **** happens and I'm not going to lose a wink of sleep over it.

I don't recall ever commenting on cop shootings of anyone. I don't see the world in black and white like you. Other than UK cops only discharging their weapons less than a dozen times last year. That would equate to about 37 per year in the USA.

So you think pouring boiling water on people is ok if they're gay?

So how does this work, me disagreeing with you and maybe the majority of the DP Fair Folk on one thing obliterates my credibility to zero on everything is what you are saying? How does that work? Let's hear a reasonably rational defense of that determination, because I got to tell you, it sounds like you are slamming all of DP with the charge of intolerance for dissenting opinions. I also point out that several have agreed with me that this sentence is to harsh.

You're being slammed for apologizing for attempted murder. The sentence was justified.

It is so extreme as to be abuse yes.

This is cruel and unusual punishment for burning someone with hot water.

If we had a Supreme Court that was worth a damn you would not see this sort of abuse of a citizen at the hands of the State.

You do realize that third degree burn of this scale have MAIMED the victims for life. There is no recovery.

I would be fine with an eye for an eye here. What do you say? Instead of sending him to prison for 40 years we pour boiling water over him while he is asleep and then he doesn't get treatment for as long as it took his victims. Well, to be fair we should do it twice to him since he had two victims. You cool with that plan?
