–It is revealed that Bill Higgins, the Pennsylvania District Attorney charging a teen with desecration of a Jesus statue for pictures simulating oral sex with the statue, had an affair in his court office and posted porn to Twitter.

While I think that charging the kid was really stupid, he did charge him based on a law on the books since the early 1970s, and he is the District Attorney, so whatever he did outside of his office isn't relevant to his job of enforcing the laws. Having an affair and being interested in porn aren't illegal acts. I think the voters who elected him expect him to do his job and not recuse himself from every potential law violation involving anything even remotely sexual because of his own transgressions.

That said, I think what the kid did was stupid, but kids can be stupid, and I hope this one doesn't have to pay a price for his stupidity.

If he was having an affair with a Jesus statue, it might be an issue. Otherwise, it's really not connected at all.

Yes, but this falls under the same catagory as laws that are no longer enforced but still on the books. Such as Texas there is still a law that says "It is illegal to take more than three sips of beer at a time while standing."

I really do hope this gets either thrown out or appealed. I believe it will be found this law is Unconstitutional.

I agree, it's a dumb law and I also hope the kid gets off. He's a dopey kid, but mine are pretty dopey too sometimes and I don't want them jailed for it. Some old laws are just nutty (like this one).

Interestingly as far as I can tell adultery was a crime in Pa until recently - last few decades. It was a crime pretty much everywhere in the US until the middle of the last century.

Somewhere in the 1970s I think it was taken off. Have to check on that one to be sure.

I find this kid disgusting but at the same time he does have First Amendment rights - something I highly doubt those opposed to my ideas would even think to acknowledging for me....

It almost seems as if you're proud of this young deviant....

Disorderly Conduct and or a lewd act in public would certainly stick....

Both are BS charges anyways but what the kid did was no different than vandalism.

The kid doesn't belong in jail - he should be scolded tho.

It's not "blasphemy" unless it was on Church grounds - even then that wouldn't even apply - it would be trespassing and disorderly conduct and potentially a lewd act.

I don't actually approve of this kind of character attack. We should evaluate what the kid did entirely on its own, without caring about this DA. Of course, there's no way that what the kid did should be against any law, but that should be the issue, not the DA's private life.

That is definitely true. More often than the religious population at large would like to admit.

That is definitely true. More often than the religious population at large would like to admit.

If I was the defense attorney it would be on every billboard, in every newspaper, on the radio and on TV what the DA did. Full court press. Play hardball like the DA is. Assassinate the bastards character.

The desecration law is as stupid as all hate crime legislation.

That being said, for those trying to create a moral equivalence...did the DA create the law? Did the DA pass the law? Did the DA arrest the kid? And are you suggesting imperfect men should not be in positions of authority or should not enforce the law? Or that their ability to lead and execute the law is eliminated because how can THEY possibly enforce ANY laws? Should this DA not prosecute murders because he is 'fallible'? Should a Chief Executive be removed from office if he is found to be fallible? After all...how can he hold anyone accountable when he himself is guilty of violation of laws?

Are you REALLY taking that stand?
