The House has held Lois Lerner in contempt, but it won’t use its power to place the former IRS official under arrest, Speaker John Boehner (R-Ohio) said on Sunday.

Under a precedent affirmed by the Supreme Court, each chamber of Congress can authorize its sergeant-at-arms to detain individuals it holds in contempt. But Boehner said on "Sunday Morning Futures with Maria Bartiromo" on Fox News that he has no interest in doing that with Lerner, whom the House last week voted to hold in contempt over her refusal to testify about her role in the IRS’s targeting of conservative groups.
“I’m not sure we want to go down that path,” Boehner said. “It’s never been used,” he said of the provision allowing Congress to arrest individuals and place them in the Capitol jail. The Senate has in fact used that power, but not in the last 80 years. “I’m not sure that it’s an appropriate way to go about this,” Boehner said.
Why that spineless little weasel. That bitch needs to be frog-marched down to the White House and presented in cuffs to Obama. I'd tell Obama to be prepared for more, as long as his lying ass instructs his subordinates to act in a corrupt manner. I don't give a **** if this hasn't happened in 200 years, this corrupt **** needs to stop....NOW. If he didn't tell her to lie, his attitude inspired her to.

The fact about the Contempt of Congress rule. It disregaurds the 5th amendment altogether. The rule[192] is applicable to whomever comes before Congress. Federal employee or citizen.

It is a farce to claim Lerner waived her 5th amendment right by making a opening statement. There is no rule in law that states when the 5th amendment must be stated to count. Regardless, Congress' own rule makes no provision for claiming the 5th. Lerner did Congress a huge favor by making an opening statement. That was the out Congress needed to claim Comtempt. Congress wants no part in having to prove to the American people if Lerner's claiming the 5th was or was not valid.

2 US sec 192

Every person who having been summoned as a witness by the authority of either House of Congress to give testimony or to produce papers upon any matter under inquiry before either House, or any joint committee established by a joint or concurrent resolution of the two Houses of Congress, or any committee of either House of Congress, willfully makes default, or who, having appeared, refuses to answer any question pertinent to the question under inquiry, shall be deemed guilty of a misdemeanor, punishable by a fine of not more than $1,000 nor less than $100 and imprisonment in a common jail for not less than one month nor more than twelve months.

No where in this provision or any other before it...or after it...has any provison for pleading the 5th[when called before Congress].

The reasons Boehner will not persue the issue is that any action by Congress enforcing 192 would look heavy-handed. Boehner was incorrect, the last time Congress arrested and fined a citizen was back in 1820. It would be a PR nightmare for the GOP.

I just would like to see the provision or rule that clarifies when the 5th amendment is valid and when it is not.
