Miami-Dade Police says officers were forced to throw a beach-going 14-year-old to the ground and forcibly restrain him because of clenched fists and "dehumanizing stares," as first reported by CBS Miami.

But Tremaine McMillian says he was merely walking along the beach on Memorial Day, feeding his puppy from a bottle, when police overreacted. Cell phone video shot by his mother shows the unarmed teen pressed to ground at Haulover Beach as one police officer holds his forearm across McMillian's throat and another places him in handcuffs.

Absolutely ridiculous if this is the full story on what happened. The police stated that the 'clenched fist' is considered an 'immediate threat.' :lamo

I swear, some of these stories I hear coming from Florida are so ludicrous they could be written by The Onion. Maybe its all that sun?

If you believe the officers, it went down when he jerked his arm away as they touched him. Sounds pretty lame. Feeding a puppy. We can't have that.

These cops need more training, in my opinion. It's not their job to escalate. Sometimes you have to let things go.

Some of the best lessons I've learned have been from cops giving me a break.
 
I think there's more to the story. Of course it could be they just got tired of the lip he was giving them and decided to treat him to an adult experience, showing him where that mouth will get him in life. Not much sympathy for the kid, though I don't think he should or will be fined or jailed.

I'm assuming the bottle he was feeding the dog with wasn't glass, otherwise for that he should be charged.

Hopefully the kid learned a valuable lesson, judging from the comments here however, he probably won't. Which will lead him directly to learning it more painfully later in life.

I pay them. I paid for their shoes. They're public servants.

I have expectations of how they should behave and body slamming and choking out 14-year-old kids because they aren't immediately compliant doesn't cut the mustard.

I'm not legally allowed to lie to the police.

That's the only standard governing my verbal interaction with them.

Some cop body slams me for telling him to pound sand and his lawyer better be better than the one I've got on retainer.

A video like that and my lawyer = cha-ching-$$$$$.

An adult does not physically assault someone, even if they are being verbally abused. At least, that is what I was taught growing up.

If the story holds true then these cops were acting like children, not adults.

I'll be a little more clear since you seem to be misinterpreting. IF the story is complete, yes the police here probably went overboard, however, not as far overboard as folks are saying. They are a very small presense in a large crowd of people at the beach, and it's their job to keep the peace. When someone, even some 14 year old punk, gives them public lip, plays games for the crowd, it undercuts their ability to command the necessary authority to do their job and often stirs up the crowd.

AND on another note, in case you've never been in the situation, 14 year olds can be masters at winding adults up. It's common behavior and most good parents know to shut it down because if left unchecked they know the attitude is going to get the kid in trouble at some later time.

AND, when it's all said and done add in the factor that these are folks with a difficult job who are human and maybe having a day from hell themselves. They're going to be a lot less tolerant when some 14 year old gives them lip.
 
There is something not right with this story as presented. Police approached him for roughhousing in the surf--he slammed somebody to the ground--he was just walking with a puppy to show them his mom--and the mom just happened to be there with a camera recording his arrest.
 
Oh, the kid was black. How shocking that the police decided to "put him in his place."
 
If this happened between 2 civilians, isn't the red line when somebody puts their hands on somebody else?

Who would get charged with assault if one was using words and the other used his fists?

There are better ways to handle the situation. Cops get lip all the time but the smart ones use their heads to deescalate the situation (especially when we're talking about a simple civil violation). Unfortunately it seems that this day in age the cops more often react to situations instead of respond to them which turns little stuff into big stuff.

Here are my immediate thoughts:


The stories of the police and the boy and family differ considerably. The boy is saying he was taking the cops to his mom as requested, and reacted to being grabbed. The cops are saying his body language and behavior was indicative of threat, and they took him down because they believed he was about to be violent. They're claiming he was resisting arrest when he jerked his arm away from a grab.

It's hard to say exactly what REALLY happened here, but given that we're talking about a 14yo boy, my immediate reaction is that this was a bit over the top.

There's also this:

McMillian was charged with a felony count of resisting arrest with violence and disorderly conduct, according to Miami New Times. His case is reportedly scheduled for trial in July.


That is nuts. Jerking away isn't felony resisting, nor is posturing or fist-clenching in and of itself, violence. Pretty sure this charge will not stand as is. Damn, if I'd charged everyone who tried to jerk away from me with felony resisting when I was in LE, that would have been a long long line...

Does the kid have an attitude problem? After watching the video I'm pretty sure he does, yeah.... but I'm thinking the cops that took him down probably do too.

yeah, something does not gee-haw here.... but I'm figuring both sides are exaggerating at a minimum.
 
The video doesn't show the cause, only the effect. My head tells me that yeah, the officers overreacted and escalated a situation that could have been solved quietly and peaceably if, like on COPS, there was a video team following them around. But without seeing the entire incident on film, it's he-said, he-said.

I just find it difficult to believe that a kid feeding a tiny puppy appeared menacing enough for the police to even approach. :shrug:
 
I'm getting tired of police over reacting. They probably need to be fired.

.... If a cop is wrong ill mouth up to him. His badge means nothing to me. He doesnt protect me. He shows up after all the crap goes down to write a ticket and be an asshole. Except for the small minority of cops ive met who do it simply to help others instead of seeking a position in society with power over others. Just speaking from personal experience here.

If I see a cop beating a helpless person on the ground you better believe ill assault that cop until he stops. Probably even take his weapons away and throw it in a bush because he obviously shouldnt have them. Just because he has a badge doesnt mean he can punk people. Of course I would probably end up in prison but id be willing to make that sacrifice to help someone beating unjustly beaten. (not saying that beating people should ever be justice...)

They prolly trumped it up because they knew they couldnt win and wanted the trump up to be an obvious reason for dismissal.

That bravado may sound cool when you repeat it in your mind, but in real life doing that will either get you tased or shot about 90 times, or until the cop's partners run out of ammo. IF you survive the encounter, you can look forward to a massive beating of your own.

Yes, it does. And 14, your "child" status is subject to change depending upon your behavior.

Btw, the kid wasn't beat at all. He was restrained and cuffed. Not a mark on him.
