A Texas lawmaker says he plans to file the Firearms Protection Act, which would make any federal laws that may be passed by Congress or imposed by Presidential order which would ban or restrict ownership of semi-automatic firearms or limit the size of gun magazines illegal in the state, 1200 WOAI news reports.


Republican Rep. Steve Toth says his measure also calls for felony criminal charges to be filed against any federal official who tries to enforce the rule in the state.

"If a federal official comes into the state of Texas to enforce the federal executive order, that person is subject to criminal prosecution," Toth told 1200 WOAI's Joe Pags Tuesday. He says his bill would make attempting to enforce a federal gun ban in Texas punishable by a $50,000 fine and up to five years in prison.

Supremacy Clause would certainly come into play with a Federal Law from Congress (not gonna happen anyway). Would be interesting to see what impact that this would have on a Presidential Executive Order that really isn't covered in the Constitution at all. If they'd dump the "Federal Law" aspect out of the legislation and just left "Executive Order," there may be some teeth to this after all.

Just more grandstanding. He must be up for re-election. All the Feds would have to do is cut off all Fed money to the state. Next time Texas burns and the Gov. cuts fire fighting money all the Fed would have to do is say burn, no money. Also I think Fed law out weighs State laws on things like this. Washington State and Co. passed pot laws but they know the Feds can step in if they wanted too.

Well I don't know if it was an executive order or not but this administration arbitrarily demanded that licensed dealers hand over the names and addresses of any and all buyers of more than one firearm just over a year ago. What ATF is doing with that IDK but I'm guessing dealers are complying or they'd be out of business. This arbitrary rule only applied to dealers in TX, NM, AZ and CA. Guess we don't care if Chicago street gangs get their guns through straw purchases - NY either.

States can refuse to allow their law enforcement to investigate federal crimes, but they are not going to be able to lock up federal officials. It is just silly to think otherwise.

I Googled and learned that he was elected only two months ago and that his father is a first-generation American.

it would be a good time to force the federal boundary issues

if the Obamatards try to ban normal cap magazines or weapons that cause them to wet their pants, the solution would be for makers to limit their sales in the state where they are located and then the interstate commerce nexus would not exist and state law protecting such weapons would be pretty damn compelling

Good Texas has joined Wyoming and Indiana.....more are joining in with their own Nullifications. Lets hope all 30 Republican States do so.

A bill just introduced in Indiana known as the Firearm Freedom Act, for instance, would also protect the rights of gun owners to be free from federal regulations if the gun was produced and purchased in the state. Similar legislation has already been adopted in other states.....snip~

Others are already in the process.

the stupid state is NY-banning 10 round magazines because of what some criminal did with a weapon that was illegal for him to have in the first place

This is nothing more than political speak that gives conservatives hard-ons. This is very similar to the speak about arresting the UN observers at the texas polls. It's only feel good speak.

Every day we come to regret more and more re-admitting these right wing states back into the Union. We should have whipped their asses, which we did, freed the slaves, which we did, and then kicked them the hell out of the country permanently.
