a federal judge has ruled that the officers at the head of the march failed to sufficiently warn the Occupy Wall Street protesters that walking on the roadway would result in arrest and opened the path for a massive class action lawsuit against the NYPD. New York’s “finest” have been accused of wrongful arrests and
unnecessary violence
multiple times as the movement grew.“A reasonable officer in the noisy environment defendants occupied would have known that a single bull horn could not reasonably communicate a message to 700 demonstrators,” wrote Jed S Rakoff of the federal district court in Manhattan, in his decision. Rakoff added that protesters “might infer permission to enter the vehicular roadway from the fact that officers, without offering further warnings, proceeded ahead of and alongside plaintiffs onto that roadway”.Video shot by marchers was a huge factor in Rakoff’s decision, and reinforced protesters allegations that the police had led them onto the roadway, indicating that it was fine for the people to follow. Police maintained that the demonstrators were sufficiently informed that walking on the area intended for vehicles would result in detention, but even their own video footage did not support this claim.

A wrongful arrest is a wrongful arrest and justice should be served. Although this doesn't diminish the hundreds of other legal arrests of OWS individuals that did violate laws and merited being arrested. You have a right to protest, but there are also other laws and ordinances that must be respected.

Then again, the illegal actions of some don't equate with the sentiment of the majority.

I hope the financial settlement is large enough to teach a lesson to NYC. The videos showed this to be wrong from Day 1, and nothing was done. The police have been too heavyhanded with protestors. Payback time.

My hope.... The NYPD gets out of the way next time and lets NYC traffic do what the National Guard should have been allowed to do last year..... See how much these worthless sacks of **** are actually willing to bleed for their cause.

No. In this case I'm advocating running them down. In terms of the NG I had advocated bayoneting. They aren't worth the cost of the bullets necessary to shoot them.

you do realize the "financial settlement" means nothing to the NYPD. it's not their money it's the taxpayers (ows's) money. so the larger it is the more the taxpayers have to pay not the NYPD right?

I do understand and perhaps the 99% will realize that they are paying for Bloomberg's Police, the 1%, and do what the 99% should do and initiate some change. A little 99% pain in the wallet might be effective here. Reaction! Maybe?

What a pathetic decision.

It was the protestors responsibility to listen to the bullhorn. Singular or not.
Nor do Officers have to repeatedly give warnings. The protestors should have listened the first time.

I hope this is appealed, any class action stayed until, and overturned.

Well we'll see if anything happens to the police departments which unlawfully arrested these citizens. Likely not, but it's NYC so it's not like it's a shining example of freedom and liberty anyway. We should take the Statue of Liberty away from them.

Can the judge show me where the 1st amendment says you have the right to block rightful commerce by preventing individuals from getting to work on time?

Not the skullduggery you want to make it out to be. It appears to be simple failure to warn due to poor police procedure. The people involved in OWS have rights and those rights are being protected.

What you have failed to mention is that the judge did not find a "pattern of misconduct" for which Bloomberg, Kelly and the City did nothing, therefore, "the ruling dismissed the mayor, the police commissioner and the City of New York as defendants in the suit, saying that there was insufficient evidence that those parties were responsible for any misconduct by the police."

Walking in the streets on a peaceful march is still peaceful.
 
I'm no fan of OWS, but they have a right to protest. If the assembly is peaceable, there's no grounds for intervention by law enforcement. If they were entrapped, which is the ruling, then I think the reparations to those wrongfully arrested should come from the pockets of the officers involved.
 
Since when do police need to warn someone before arresting them? Do they need to send it in writing, in triplicate, too?

as long as you are not striking others, you are being peaceful. Non-violent protest and passive resistence includes blocking traffic with your passive body.
