Seriously, a felony over one dollar's worth of soda? Where's the justice in this? How can some people spend less than a year in jail for killing people, and then this guy is charged with a felony for $1's worth of soda. This is absolutely ridiculous, and an embarrassment to our legal system.

Well he's white, and there's a quota to be met for whites to be arrested and charged.

I will wait to get all outraged until he is convicted of a felony over this. Charges get reduced all the time, witness the repeat DUI sentence. Perhaps the DA is attempting a wake-up call. Been done plenty before. Seen many a repeat crack head get a slap on the wrist, even with repeat failure to appears. Takes a lot to get thrown in prison.

Check this out, if the serial thief had just paid the buck, or didn't have the criminal history he did, he wouldn't be looking at felony charges. How about, instead of blaming the law, we actually fault the guy who was stupid enough to earn himself a felony charge for taking something so silly.

X, while I do not like three strike laws, the fact he was arrested and is being charged with a felony is not the issue I have with any of this. My issue is who the hell calls the cops over a dollar cup from McDonalds.

it has NOTHING to do with any 3-strikes laws.

he has three charges against him, and they decided to up the theft to a felony, as he is a repeat offender. clearly, getting chaged with misdemeanors has NOT taught him a lesson.

This is ****ing ridiculous. I don't give a crap if he has previous convictions for armed robbery, first degree murder, and child molestation. It's a freaking $1 cup of soda from McDonald's. The kind of thing that LOTS of people do without even thinking about it as theft.

these charges are appropriate.

You wanna foot the bill for his prison cell yourself? Or do you expect the taxpayers to pay to keep this menace to society off the streets so he can't threaten the public anymore by taking $1 cups of soda?

I agree. What is even more ridiculous is that I *knew* as soon as I clicked on the thread (before I even read any of the details of the case) that a certain cohort of DP posters would be rushing to support this idiotic charge. And at least one person in this thread has already insinuated that he should be raped.

You're right, it is an embarrassment to our legal system. And that system only exists because we have so many embarrassments to humanity who vote. :(

Agreed. I don't understand why locking someone in a cage is the default punishment for wrongdoing anyway. If the person's physical presence in society doesn't pose a threat to the public, then I think locking them in a cage is a grotesque violation of human rights (especially in light of all the other abuses that occur in our prison system). IMO, the only people who should be there are violent criminals who people are legitimately afraid of.

For everyone else, there are other methods of deterrence: House arrests, community service, fines, ankle bracelets, public shaming, halfway homes, etc.

Stealing a $1 cup of soda barely even qualifies as an arrestable offense. If I was the police officer who got called for that, I'd probably be pissed at the McDonald's employee for even wasting my time. Or if I felt like it, maybe I'd lecture the guy for a bit about paying for his soda, then make him go back and give the cashier a dollar. And that's it.

The fact that some of the people on this thread think this is justice is the true injustice. Humanity is ****ed up. All these people walking around thinking they are "do good-ers" yet they are far more foul with their comatose/apathetic sense of justice.

I hope the people that advocate this arent self declared Christians, or think themselves good people in general (but of course they do). To be this far confused it a travesty.

I wouldn't go so far as to try and bring religion into the mix. I'm sure there are plenty of religious people who disagree with what is happening to the man, myself included.

For one, how is it trespassing? People shuffle into McDonald's on a daily basis. Is it only trespassing once you've stolen an item?

I myself can compare to Christians. Modern day forgive once the truth is out type of Christian. But I also included, or people who think they are good for non-religious.

I included 2 routes. Is a 2 way road not good enough for you? Must you have it only 1 way in your direction?

Wasn't he also arrested for "disorderly intoxication" and trespassing as well? Normally criminal trespass means someone has been warned to leave but refuses to. My guess is that's the real reason the cops were called in the first place.

In any case, none of that **** merits a felony charge REGARDLESS of prior convictions. At most, it merits a night in the drunk tank and a small fine.

5 years may seem like a lot but this guy is a repeat offender for theft. His actions cause the rest of us to pay higher prices for everything they steal. Chances are everytime he had been charged in the past was as simple as a slap on the wrist. Looks like this time they are getting serious and making an example out of him. Seems to me he deserves what he is getting.

Are you serious? It costs about $50K to incarcerate someone for a year, never mind the cost to go through the court system. You could fine him, garnish his wages or community service. Put him in prison for a few years an he becomes a hardened criminal, not a petty PITA.

It's completely unreasonable to expect ex-convicts to suddenly behave perfectly when they get out. And by "perfectly," I mean exactly that. I'm not talking about expecting them to avoid major infractions of the law in the future, like we would expect of anyone else...I'm talking about holding them to a ridiculously high moral standard that you don't hold anyone ELSE to.

Ask yourself this: If YOU took a $1 cup of soda from McDonald's without paying for it, or committed some equivalent crime, do you think that YOU should go to prison? And don't lie and say that you never have, and never would, do such a thing. You're a human being, and therefore you probably break the law in similarly minor ways nearly every day without even thinking about it.

So if you expect ex-convicts to behave literally perfectly for the rest of their lives, and want to send them back to prison if they don't, then what's the point of letting them out of prison in the first place? No human being can possibly meet that standard.

The BIG, obvious difference is that I don't have any prior convictions for theft (or any criminal record, at all). His prior record is part of this charge. In a sense, I do expect ex cons to adhere to a higher standard because they've been given the chance to learn from their prior experiences - probably numerous times before. At some point, there has got to be greater consequences for those who continually break the law.

You can walk into McDonalds, pay for a soda and have 100 free refills. It's outrageous to have taxpayers pay $250K to incarcerate the dude to prove a point. It seems "conservatives" are into old testament, hellfire and brimstone punishment at any cost rather than rehabilitation. Taking every petty thief off the street and putting them in prison is pointless. Have them preform community service in a meaningful way can only help and save taxpayer money at the same time.
