On January 25, 1994 the Chandler's lawsuit was settled out of court with $15.3 million to be held in a trust fund for Jordan,[33] $1.5 million for each of his parents[34] and the family's lawyer slated to receive $3 million based on a September 1993 retainer,[35] for a total of $21 million (or according to CNN, $5 million for a total of $23 million).[34] Jackson's insurance company "negotiated and paid the settlement over the protests of Mr. Jackson and his personal legal counsel" and was "the source of the settlement amounts"; as noted in People v. Jackson in 2005.[36] A number of precedents in California had established the right for an insurer to control the settling of claims covered by the insurance without interference from the insured.[36] Overturning a precedent involves convincing a court to overrule the precedent, if it has the power to do so,[37] or convincing it to distinguish the case.[38] In 2004, Jackson's attorney Thomas Mesereau said, "People who intended to earn millions of dollars from his record and music promotions did not want negative publicity from these lawsuits interfering with their profits...Mr. Jackson now realizes the advice he received was wrong."[39] The settlement did not prevent the Chandlers from sharing information about the case in a criminal investigation or testifying in criminal trial.[40][41] The criminal investigation continued. Police investigating in two different counties never pressed charges.[42][43] Grand juries in Santa Barbara County and Los Angeles County before and after the settlement refused to indict Jackson.[26][44][45] After Jordan Chandler refused to testify in criminal proceedings, the state closed its criminal investigation citing lack of evidence on September 22, 1994.[46] Sneddon said two other possible victims had been identified out of 400 witnesses interviewed, but one was in therapy and asked not to be involved and the other was out of the country and had made a "general denial" of wrongdoing by Jackson.[46] In June 1994, prosecutors and detectives had flew to Australia to again question Wade Robson who said he had slept in the same bed as Jackson and again he said nothing bad happened.[43] Jackson's support amongst the public began to waver, and his public image was tarnished to a degree.
