This should piss off those who think we should toss the salad of terrorists and extremists.

This is not the defense of some anti-Muslim bigot, this is the defense of free speech and not once have I spoke out against the ground zero mosque. I figured I had better bring that up before some retard suggest that this is a defense of a anti-Muslim bigot.

A Koran-burning New Jersey Transit worker, fired for his protest near Ground Zero last Sept. 11, is getting his job back - along with an extra $25,000 for his troubles.

Derek Fenton, 40, will also collect back pay since his Sept. 13, 2010, dismissal for torching pages of the Muslim holy book on the site of a proposed lower Manhattan Islamic center.

The deal additionally pays Fenton $25,000 for pain and suffering and restores his pension credits.

"I feel relieved I have a job," Fenton told the Daily News yesterday from his Bloomingdale, N.J. home.

Earlier, the 11-year NJ Transit employee released a defiant statement.

"Our government cannot pick and choose whose free speech rights are protected, based on whether or not they approve of the context of our statements or actions," Fenton said.

"This is the very essence of the First Amendment."

Fenton, a train conductor, will return to work next week if he completes a physical and a drug test on Monday, said Deborah Jacobs, New Jersey executive director of the American Civil Liberties Union.

It's good he got his job back. I've never supported employers (public or private) that try to regulate completely legal actions that you take in your private time by threatening to fire you if you do them.

With public employment, certainly. I'm not sure I really agree with private employers, though, at least not in all cases. For example, if I spend my private time running IhateBestBuy.com, I can see why Best Buy has a pretty good case for firing me :D

I'm with Deuce on this one, if it's a public employer they have no right to do such a thing (unless you're in the military). I think private employers are a different story.

I wish they hadn't settled. I'd rather it had been ruled on. I don't think the courts have been 100% clear on it.

Good for him, though.

Settlements are so common because they save everyone time and money, and the judge doesn't have to go out on a limb and actually, you know, decide something. It's win-win-win! Isn't our system grand? ;)

It was a civil suit. I support the right of litigants to reach settlements as it suits them.
But personally, I would have liked to see how it would have shaken out.

I love how the left claims to care about constitutional rights but pisses all over the 2nd amendment and I love how the left clamors to defend flag burners right to right to free speech but not the free speech of the Koran burners,conservative speakers at universities and military recruiters.

I'd be firing the idiot who fired him for costing taxpayers his paid vacation since 9/11/10 and the $25,000 in pain and suffering. That "little mistake" probably cost taxpayers $50,000 or $60,000. When will we begin holding responsible those people who are causing such a gross waste of taxpayer dollars??

I think you would have to go all the way to the idiots who enacted the rules that says he could be fired for burning Koran pages. Firing the person who fired him might just mean there is a similar thread months or a year from now of that guy getting back pay and pain and suffering.

Youre in the wrong country

Work a schedualed 32 hours a week and pick up an overtime shift once a week, while working evenging, midnights and weekends and you will earn more then that in Alberta

There was no rule like that. Somebody used very poor judgement. A rule like that would be unconstitutional. Sometimes the right thing to do is to check with "legal." The guy who made the decision is prolly paid $175,000 a year so that he knows when he should check with legal. As usual, no one's accountable.
