Washington (CNN) -- A Kansas church that attracted nationwide attention for its angry, anti-gay protests at the funerals of U.S. military members has won its appeal at the Supreme Court, an issue testing the competing constitutional limits of free speech and privacy.

The justices, by an 8-1 vote, said Wednesday that members of Westboro Baptist Church had a right to promote what they call a broad-based message on public matters such as wars. The father of a fallen Marine had sued the small church, saying those protests amounted to targeted harassment and an intentional infliction of emotional distress.

"Speech is powerful. It can stir people to action, move them to tears of both joy and sorrow, and -- as it did here -- inflict great pain. On the facts before us, we cannot react to that pain by punishing the speaker," the court's decision said.

But it is free speech.

I may not like it, but that's the way it is.

At the end of the day, I actually feel nothing but sorry for the members of the WBC, to dedicate your life to this kind of hate, and to go out of your way to inflict this kind of pain on a grieving family shows a lack of happyness and fulfillment in your life, and for that, I truly feel sorry for them.
 
Those people are vile in my opinion, but the court made the correct decision.

I agree that it is free speech, which gives me a couple of great ideas.

1) Every time someone from WBC dies, picket HIS funeral with signs that say he is going to hell. Make HIS family cry, and maybe they will see the light and leave the **cough** church **cough**.

2) Next time they picket, somebody just kick their asses, and then a new case can go to the Supreme Court, seeking a ruling on whether inciting a riot is considered free speech.

Good decision by the court.

It doesn't bother me any. The Westboro Baptist Church has been making the case for gay rights for years.

These people are nothing more than scam artists, they make their living provoking and suing people.They are no better than the ambulance chasers who file frivolous lawsuits against companies. I seriously doubt they give two ****s if you are gay, straight, in the military, a civilian or what ever. If you can cut these people ability to profit from lawsuits I guarantee they won't be protesting at funerals, street corners or where ever the hell else. They basically provoke people into violating their rights, then sue them for it and collect money. It wouldn't surprise me if one of those members of the Phelps family got kids in the military or gay kids that they are keeping hidden in order to keep up their charade.

CP, they want your attention. They revel in it. It's like a church for real life trolls. They're not worth a second thought, much less possible legal charges.

Fred Phelps does not believe what he is doing. This is a scam.

It's a business. They travel the country, set up websites telling you exactly when they'll be there, and using the most inflammatory statements all over the place, just to get someone to violate their rights for profit. Then they sue the military, the police force that was to protect them, and everyone that is around them for money. This is a sham, and it is a trap to get people sued. Every member of his family is an attorney. Phelps does not break the law. What he does is try to make you break the law by trying to punch your sensibilities about everything you hold dear, and then sue you and everyone municipality around him to the max.

This is a scam.
 
Good ruling, these assholes aren't important enough to change our countries most important law.

I should feel right at home in heaven. I got used to marines waiting on me when I was in the navy.

This is, of course, the only right ruling. I don't like that WBC can continue to do what they do, but nobody said freedoms where easy.
 
It's the right ruling, I just wish they threw in, "Oh and if you want to throw sharp pointy stones at these people who are protected under free speech, you can do so without fear of prosecution". That would just make it awesome! Alas... back to daydreaming about such things...

Those religious nuts are disturbing the peace, club them in the head. They are NOT petitioning the government for a greivance, and does not qualify as "peaceable assembly".

Second, throw all the Supreme Court in jail for incompetence.

Please in detail describe whats wrong with the ruling and why you feel it isn't correct given something people highlight alot these days now there's a black democrat in the white house.
