Re: South Dakota Justifiable Homicide Bill Under Fire as Critics Say It Invites Murde

So essentially you're in favor of legalizing murder, as long as its murder you approve of. The law states that it could be justifiable homicide if you kill someone whose intent is:

"to harm the unborn child of such person in a manner and to a degree likely to result in the death of the unborn child, "

Note, doesn't say "harm the unborn child" illegally...but simply says harm it. So a doctor performing a legal 1st trimester abortion...hell, a person in a clinic giving the person the morning after pill...could be concievably killed under "justifiable" homicide for doing a completely lawful act that is part of their job.

How in the world is allowing people performing a legal action that is part of their job be legally murdered a "good" thing. Even if you think abortion is a bad thing, legalizing further murder isn't a solution.
I support legalizing self defense. I think it should be legal for someone to kill an attacker that is trying to kill a woman or her unborn child. I believe unborn children deserve to be treated equally with human rights, and as such deserve to have killings for their protection being classified as self defense just as it would be for an adult. As long as abortion is legal though, and as long as women are wrongfully allowed to legally chose to kill their children, I do not think the law should apply (in these cases). I wouldn't support this law giving individuals the ability to enact capital punishment upon abortion providers or women who wrongfully chose to legally abort. As long as abortion is legal I don't think this law should apply. However I feel abortion should be repealed.

I support legalizing self defense.
Acting out in self-defense or in the defense of others is already legal. Read Runyan vs. State:

In Runyan, the court stated "When a person, being without fault, is in a place where he has a right to be, is violently assaulted, he may, without retreating, repel by force, and if, in the reasonable exercise of his right of self defense, his assailant is killed, he is justiciable."

I also think it should apply to the unborn though and should be legally defined as acceptable to defend an unborn child using lethal force if necessary.

It does apply...? A pregnant woman is perfectly justifiable in using self-defense if someone is trying to harm her or her fetus.

Arghhh... make them go away!!!

Re: South Dakota Justifiable Homicide Bill Under Fire as Critics Say It Invites Murde

Baby | Define Baby at Dictionary.com
5.a human fetus.

snip..

2. an unborn child; fetus

....that's why you remain a sanctamonius person and a dumbass

So says the person trying to tell another person that a fetus is not a human being, believes in the idiotic nothing that republicans are the party of the rich and failed to properly spell sanctimonious.

slave to the party-of-the-rich
Duh we pu bee cans iz e-vile rich peoples and der de democrawts is is is ga go gu-ood. I can't believe people still utter that retarded crap.

"Child" 1 and "baby" 1 have pre-birth uses.
A fetus is a "child" 2 and a "baby" 2 is a "child", thus we can call a fetus a "baby" 3.
Legally a "child" 4 is one's natural offspring, which is what a pregnant woman carries.
So, a pregnant woman carries her "child", her "unborn child", her "unborn baby".
This makes her a "parent", specifically, a “mother”.

"Organism" = "a living being".
Human DNA = "human".
"Organism" + Human DNA = "A Human Being".

I agree with you here. However it may not be legal for a woman to use lethal force if necessary should an attacker have the goal of killing her unborn child.

A fetus is a human being. I'm not a Republican if that's what your trying to get at with the "party of the rich" accusation. I also don't appreciate being called a dumbass. I respect you and your views, please respect me and mine, let's have a civil debate.

Glad I made myself read to the end. I was going to argue with a whole bunch of what you said and how it doesn't apply...but you basically sum that up in the end. I agree with a lot of what you say. But the difference between self defense for an adult and what this would allow is as an adult you're allow to commit self defense when someones violating the law to harm you or yours. Until abortion is illegal, it can't be compared under a legal sense.

It is legal... I showed you the court case that makes self-defense justifiable in the face of imminent threat.

In Runyan, the court stated "When a person, being without fault, is in a place where he has a right to be, is violently assaulted, he may, without retreating, repel by force, and if, in the reasonable exercise of his right of self defense, his assailant is killed, he is justiciable."

According to the bill history linked in the OP, the bill was tabled for Feb22nd. However, I just heard on the radio that the bill was defeated today. No link yet.

a human bean?

LOL!

now, c'mon, commies, knuckle draggers, haters and angels, and all stripes in between---

there's gotta be ONE thing we can all agree on

human beans---now THAT's funny!

Re: South Dakota Justifiable Homicide Bill Under Fire as Critics Say It Invites Murde

The bill's chief sponsor told the Washington Post...

"This code only deals with illegal acts,"
"Abortion is legal in this country. This has nothing to do with abortion."

This mean killing a doctor who is legalize to do abortion is a crime.

But that doesn't matter cus I'm pretty sure
you extremist vigilante abortionist out there don't care for the law anyway.

Re: South Dakota Justifiable Homicide Bill Under Fire as Critics Say It Invites Murde

If the bill were intended to refer only to legal acts of self-defense against illegal acts of aggression, they should not have amended out the language that actually said that.
