Andrew Mikel II admits it was a stupid thing to do. In December, bored and craving attention, the 14-year-old used a plastic tube to blow small plastic pellets at fellow students in Spotsylvania High School. In one lunch period, he scored three hits.

"They flinched. They looked annoyed," Mikel said.

The school district saw it as more than a childish prank. School officials expelled him for possession and use of a weapon, and they called a deputy sheriff to the scene, said Mikel and his father, Andrew Mikel Sr.

The younger Mikel, a freshman, said he was charged with three counts of misdemeanor assault. The case was first reported by the Web site WorldNetDaily.

Spotsylvania school officials declined to comment on the incident, citing student confidentiality rules. But documents that the school produced when Mikel's father filed a Freedom of Information Act request show internal division over the matter.

The federal Gun-Free Schools Act mandates that schools expel students who take weapons, including hand guns, explosive devices and projectile weapons, to school. E-mail traffic among school officials showed they ruled that Mikel's plastic tube, which was fashioned from a pen casing, met the definition of a projectile weapon because it was "used to intimidate, threaten or harm others."

More proof the public school system is worthless.

Mikel will be cleared of the misdemeanor criminal charges if he participates in a year-long diversion program, he said. The county sheriff's office did not return messages seeking comment.

I truly hate zero tolerance policies. They teach children that authority is completely unfair and unreasonable. It dissociates the concept that rules are based on good behavior, and make everything seem arbitrary. Would you expect that kids classmates to tell a future cop the truth, knowing that even the most benign actions could screw you over?

Thank you. My son hates school, and this kind of crap is one of the reasons. Kids get away with acting like utter asses, but at the same time certain things are treated like felonies that used to be considered normal mischief.

My son is 15. This year, with much misgivings and considerable regret, I taught him something important: if you're ever interrogated by the police, give your name and address, tell them your age and how to contact your father... then shut up and say nothing more, no matter what they say or ask.

I hated having to do that. Really did. It's yet another "loss of innocence" moment, but he will be driving soon and before long he will be out on his own, and he needed to know it.

On top of that I'm an ex-cop, and it pains me to admit that if you're suspected of a crime you didn't commit, you are better off not talking to the police. It's true though. Let your lawyer do the talking for you.

That's just ****ing ridiculous, if they'd had those rules when I was at school I would've been expelled after 3 weeks, policies like this are just plain ridiculous.
 
I read the thread title and figured it would be like a pellet gun.

interesting comment, you actually started with evidence contrary to your point which you leave unsupported. authority in this country today is unfair and unreasonable and arbitrary. why lie to them and make them believe otherwise. they'll have to figure out how to operate in such a system sooner or later.
 

I wouldn't have lasted long in the modern school system. It being run by dolts and the mentally handicapped, which is an insult to the latter. Reminds me of moderators on some political forums I'd been to in the past who overstep their roles. "Worthless" is probably the perfect description.

I wonder what they would have made of our sling-shots?

I remember when I was in high school my civics teacher said to the class that zero-tolerance really meant zero common sense. I think this proves it.
 
This merited a trip to the principal's office and maybe a stern phone call to a parent. To arrest a 14 yr old for a felony for basically shooting spitwads through a straw is beyond the pale. The world has gone mad.

You will rarely find either the police or courts as unreasonable as a school with zero tolerance policies. Cops and judges have considerable leeway in how they operate, and are expected to tailor punishments to specific circumstances. You at least have a chance of someone looking at the mitigating factors and not screwing you over. Schools on the other hand, feel obligated to levy the absurd punishment nearly 100% of the time regardless of the actual impact on the misbehavior.
 
Zero tolerance policies made high school much more exciting, especially with fights.

We did have fewer fights than other school districts, but the fights we did have were MUCH more brutal than the fights in other districts. Other districts, you'd get roughed up, a black eye, couple of bruises, a bloody nose. Our district, you got your jaw broken, hand crushed, skull cracked, or your knee smashed.

Our fights were more brutal because of the zero tolerance policy, we figured "Well hell, I'm getting suspended no matter what, I might as well get my money's worth." Even if you didnt throw a punch, you got suspended as if you'd started the fight.

What a completley idiotic and ridiculous ruling. Seriously, I wonder about people and common sense these days.
 
Why is it that we're turning kids over to the cops and such these days? I can't believe we actually legally pursue these matters, it should have been dropped all together. No participation in some stupid class or whatever, it was a kid thing that kids do and that's that. No one got hurt. Yell at him a bit, tell him he can't do X, maybe send a note home to the parent. Done and done. Why the hell have we lost all common sense in this country? I think that's really what's driving our downward slide.

He was arrested for 3 misdemenor charges, not a felony. Still stupid though.
