WASHINGTON, D.C. - Rep. Dennis Kucinich has rapped a U.S. House of Representatives cafeteria with a $150,000 lawsuit for selling him a vegetarian sandwich wrap in 2008 that he says caused dental damage when he bit into an olive pit.

"Said sandwich wrap was unwholesome and unfit for human consumption in that it was presented to contain pitted olives, yet unknown to plaintiff, contained an unpitted olive or olives which plaintiff did not reasonably expect to be in the food prepared for him, and could not visually detect prior to consumption," the lawsuit said.

I don't know how to respond to this except my very first DP ...

This happens far more often then most people realize. I guess this just goes to show that anyone can be guilty of wanting something for nothing.
 
I can see suing for the cost of dental repairs and minor punitive damages, but 150k?

edit: Although admittedly, most lawsuit claims are made without the intent of actually recovering that amount, but rather helping convince the defendant to just settle.
 
Ridiculous. The proper way to deal with something like this is to call the restaurant manager to the table immediately, show the evidence (olive pit) and the damage caused. Usually the restaurant will apologize and agree to pay any resulting dental bills. If the restaurant manager acts like a prick, then the proper course of action is to get the damage repaired, send a copy of the bill to the restaurant with a payment demand and a time limit. After that, a small claims lawsuit remedies the situation.

It's Kucinich who is being the prick here.

This is exactly the kind of tort reform we need in this country. What a classic example.

Guy needs, maybe, $1,200 worth of dental bills covered...maybe a lost days work...maybe double that amount as punitive. Sues for $150,000. Reeeeedickalus.

What a horrendous example for a congressman to set.

Even if he ends up getting any money, it won't be from the cafeteria. They will likely tender their defense to the olive supplier, who will turn it over to their insurance. He probably can expect a denial from the insurance carrier, or at best, a paltry settlement. He won't get what he's asking for.
 
Gawd.

Shake yourself Kucinich. He really needs to change that tampon of his from time to time.
