(CNN) -- A decorated flight nurse dismissed under the "don't ask, don't tell" military policy will be reinstated with the U.S. Air Force, the American Civil Liberties Union of Washington said.

The ACLU of Washington represented Maj. Margaret Witt in a 4-year-long lawsuit seeking her reinstatement.

In September, the U.S. District Court for the Western District of Washington ordered the Air Force to reinstate Witt. The court found that Witt's sexual orientation does not negatively affect unit morale or cohesion. On Tuesday, the Justice Department appealed that ruling, but it is not seeking a stay of the order to reinstate Witt, clearing the way for her to rejoin the service.

"I am thrilled to be able to serve in the Air Force again," Witt said in statement Tuesday. "The men and women in the unit are like family members to me, and I've been waiting a long time to rejoin them."

There was no immediate Justice Department response Tuesday to a CNN request for comment.

Here we see all the facts laid out. If in fact she did not tell anyone about her relationship, and kept it secret (which it appears she did) then it seems she shouldn't have been discharged under DADT. Obama already said that Congress must pass a law, what part of that don't you get?

Personally - I think it's pathetic that they'd boot a nurse for any reason other than an inability to do their actual job.

Worse was the decorated Air Force pilot who we'd spent millions of dollars training and booted because OMG HE LIKES DUDES!?

I mean, I know he's got nine air medals, but we just can't trust a man like that! :roll:

The fact that she should not have some gag order and can in fact be booted for something as simple as hand holding is why it is bad. I know exactly how DADT works, it is in fact bad.

It doesn't get more basic than this: if they are competent experts in their field and they are conducting themselves with professionalism, there is no reason for ANYONE to be kicked out, period.

How hard is that for the pro-DADT people to grasp? The sky isn't going to fall. Life goes on. It did for minorities and women in the military who gained social victories. It will for gays as well.

They're going to be allowed to serve openly whether you like it or not. I suggest you get used to it. :shrug:

If a male soldier had the same conversation with a female soldier, he would get busted for sexual harassment. Your ignorance of a system that you hate is astounding.
