Dont worry fellow liberals, I have a really good feeling about this nominee. As a bonus, maybe she will turn out to be a lesbian. The nations first lesbian Supreme Court Justice. O, what I would give to see the reaction on the extreme right if that turns out to be the case.

oh yeah... none of them were judges first.:doh:doh

Bah, if ever there was a place for libertarian philosophy in government, it's in the SCOTUS.

Many gay/lesbian people are quite conservative on many issues.

Good point. However, I don't believe the president would nominate her if she was very conservative, and from what I understand, he knows her well.

The destruction of the country ... perhaps, I should say the "fundamental changing" of America *for the worse* amuses mosts lefties I know.

Why?

No...what it means is that you can't expect a document that was written over 200+ years ago to have been able to take into account new technology and things that we have learned in the last 2 centuries.

I would argue that expecting a document that was written over 200 years ago to have been a crystal ball which could interpret the issues that present themselves today is foolish.

That has nothing to do with the dispute over the interpretation of the Constitution. Neither the idea that the constitution embodies a right to privacy that includes abortion nor the idea that the eighth amendment bans capital punishment are the result of new technology. They're the result of judges pretending that the Constitution should be redefined to fit their policy desires.

What....by adding an amendment defining corporations as persons?

Again, if you refuse to engage in the slightest bit of self-education re: corporate personhood, I'm not sure why you would expect anyone to take you seriously. Read First National Bank v. Belotti. Corporations have always enjoyed many of the same privileges as persons, and it's by no means a "right-wing" idea.

I'm not specifically talking about this thread. Just wait....the right-wing is going to go ape over her sexuality on this confirmation. There is no way they are going to hide their true colors.

Kagan is almost certainly a lesbian. I doubt many other than the most strident social conservatives or social liberals will give a ****. Most other people will support or oppose her based on her philosophy and her record or lack thereof.

I know I get big yucks destroying the country. It's not my fault you have no sense of humor.

My sense of humor suffers everytime I write a quarterly check to the feds to feed and house your ilk.

"President Barack Obama will nominate Solicitor General Elena Kagan to the Supreme Court, a person familiar with the president's thinking said Sunday night."

"Yet Kagan would be the first justice without judicial experience in almost 40 years. All of the three other finalists she beat out for the job are federal appeals court judges, and all nine of the current justices served on the federal bench before being elevated."

This nominee has no experience on the bench, a potential problem for her confirmation. Of all the people that could have been picked, this is not the best. There is nothing substantial to grant her confirmation on. Why would the Obama administration choose someone without at least a little bit of experience on the bench?

Her nomination should not be confirmed, she lacks the experience to serve on such an important seat.

AP source: Obama chooses Kagan for Supreme Court - Yahoo! News

Time for me to weigh in on this, and I am going to very much enjoy posting this.

I have a huge problem with Kagan. But I posted the same reason when Bush nominated Meiers, and was extensively attacked and told that my opposition to Bush's pick was only because I was a Bush hater. Ironically, many of the same people who supported Meiers, and who did not think much of the reason I was against her, are now bashing Kagan for the same reason.

Unlike many of those hypocrital political hacks who were attacking me when I posted against Meiers, I am true to my beliefs, and will now proudly, once again state the reason for my opposition to Kagan, which is the exact same reason I was against Bush's pick of Harriet Meiers.......

She has no judicial experience.

How about that? And I can say this without the least bit of hypocrisy, because I did not make my decision just because someone had an R or a D next to their name. To those who did, or those who are, put that in your pipes and smoke it.

Unlike a few here, I have earned the right to bash Obama, because I don't bash him just because he is Obama. And I didn't bash Bush just because he was Bush. And, finally, I never once flip-flopped on this issue, on the basis of who the president is or was at any particular time. I called it exactly as I saw it when Bush was in office, and I call it the exact same way now. I can't speak for anyone else, but personally, it feels damn good not to be owned by one side or the other. My political compass is in excellent working order, thank you.

Dick Morris in pantyhose is how someone described her. Actually given their two proclivities, Dick Morris probably wears pantyhose more than Kagan. one of my colleagues, a Harvard Magna noted that everyone at Harvard assumed she was gay (and he is a liberal Jewish guy who worked for Obama's campaign) but said she was a pretty good dean of the HLS.

She was picked because I believe she is seen as easier to confirm while keeping women happy. That there are no protestants on the court doesn't really bother me but given the quota games Obama plays it is worth noting

I also note that judicial experience is actually LEAST IMPORTANT at the Supreme Court level given how decisions are made. It is at the TRIAL LEVEL that a judge-all by him or herself-must rule on objections ASAP. Supreme court justices have 8 other justices and several brilliant law clerks to bounce ideas off-There have been top justices with no experience including CJ Rehnquist and liberal Icon Earl Warren.

I am old fashioned in the sense I think a president should be able to pick whomever they want as long as t hey are competent. Is Kagan the best possible liberal? of course not. If you wanted a Jewish Lesbian then Pam Karlan is better but she is probably too liberal. Akhil Reed Amar is certainly smarter as well. But she certainly is qualified

Because you're perspective is all wrong. It is the "lefties" who are the ones trying to maintain this countries values. It is the right-wing that is trying to sell out America to the fundamentalists and the Corporations.

Nobody, right or left, is attempting to sell America out. They both love America. They just have different ideas on the direction it should take. The dialogue between you and webrockk is a prime example of what is wrong with America at the present time.

Everybody wants to talk and attack, but nobody wants to listen.

Unregulated abortion, bans on capital punishment, and a constitutional right to gay marriage are part of this countries original values?

When the far-righties, driven by bitterness and a hint of bigotry over the outcome of an election, have began forming these growing delusions of persecution and 'socialism'...

Delusions.

I can't answer 'why', because the 'what' doesn't exist in real life.

My perspective is centered around EQUAL, unalienable rights....the rights your ilk trample to ensure those that won't get off their ass to make a living, those that squirt out broods to "make a living", those that have children they can't afford, those union ****s that demand $35.00 an hour to push a broom, and those that enter this country illegally can continue to vote for the progressive trash you support.

"A hint of bigotry" Yes, the mating call for all lefties....squawwk...racist are everywhere...Squawwk!!

The right to be free of governmental intrusion, the right against cruel and unusual punishment and the right of equal protection under the law are ABSOLUTELY part of this countries original values.

Remember....there is something in the pledge that even says Freedom and Justice for ALL (not just some).

how is capital punishment cruel and unusual punishment given it was widespread at the time the founders wrote the constitution and lethal injection is far more humane than the hangings of the day that didn't even use a proper weight to height drop to guarantee a quick death. In fact the term "string someone up" meant death by strangulation and that was common back then. so were firing squads with weapons that were lucky to group a foot at 25 paces.

gays have equal protection-they can marry someone of the opposite sex the same as everyone else

We don't support much of what you claim. I am against government handouts although I believe in a right to work state. I don't support corporations moving high paying manufacturing jobs overseas so that corporations can increase profits for their millionaire/billionaire CEO's.
I believe that workers should be paid a living wage and that corporations shouldn't be able to exploit the workers.
I support immigration reform, while recognizing the need for migrant workers.
I believe that the true way to go about immigration reform is to go after the companies that profit off low wages they pay to undocumented workers.

Oh...and by the way....you need a civics lesson. People who enter this country illegally can't vote. Did you not realize that? :doh

Standards of decency change. Most civilized countries recognize that state sponsored killings are inhumane. We are now in the same category as countries like Iran, Iraq and third world countries in our thinking.

As for your second argument...it doesn't even warrant a response. That reasoning has been rejected time and again and is now only used by the desperate right-wing who have no other argument.
Ever follow the Constitutional scholars who write on arguments against gay marriage? Let me give you a clue...they have better arguments than that one. :2wave:
