Obama: gay partners should have hospital access

The Federal Marriage Amendment (FMA) (also referred to by proponents as the Marriage Protection Amendment) was a proposed amendment to the United States Constitution which would have limited marriage in the United States to unions of one man and one woman. The FMA would also have prevented judicial extension of marriage rights to same-sex or other unmarried couples, as well as preventing polygamy. An amendment to the U.S. Constitution requires the support of two thirds of each house of Congress, and ratification by three fourths of the states (currently thirty-eight). The most recent Congressional vote to take place on the proposed Amendment occurred in the United States House of Representatives on July 18, 2006 when the Amendment failed 236 yea to 187 nay votes, falling short of the 290 yea votes required for passage in that body. The Senate has only voted on cloture motions with regard to the proposed Amendment, the last of which was on June 7, 2006 when the motion failed 49 yea to 48 nay votes, falling short of the 60 yea votes required to proceed to consideration of the Amendment.

Well I don't think that would ever pass...........Thanks for the update............

It's already been shown that there are indeed still some hospitals where visitation is barred for gay couples, so yes, it did solve a real problem.

The article you posted showed a COMPLETELY different scenario...one that will not at all be impacted this awesome and all inspiring EO. Or did you just intentionally ignore that reality.

This only becomes a problem in an ICU situation, when the patient is on a vent, and the next of kin of the unconscious, unmarried patient are his/her parents. They disapprove of the patient's boyfriend/girlfriend, and they pull rank. It can affect both heteros and homos alike, actually.

And you get of course that this EO does NOT touch that scenario...right?

What's actually amazing is that you think you've actually countered ANYTHING. You haven't. Like I said, I'll wait for you to make an argument... but I doubt you will actually make one.

Isn't that adorable. Another analogy that doesn't fit the situation. Let's see if you can argue any more poorly. Come on Vance... I'm SURE you can do worse.

And look. Another clueless comment. Quite impressive.

Riiiight. And you actually have a DEGREE....

OK..one last time...because frankly...ya bore me to tears...

1-This legislation did absolutely nothing. Conscious patients can already dictate who visits them. Comotose patients CANT and wont be impacted by this EO.

2-This is nothing more than hyped political tripe that accomplished its intended goal of distracting the sheep into believing Obama cares.

3-As I stated before...you are beyond Dom Delouise kind of silly if you think passage of these idiotic EOs anger or annoy me. I could not care less...not even if ya paid me. No...what bothers me is how easily (and eagerly) fools swallow this kind of crap.

Present company excepted...of course...

From the OP

"The White House on Thursday released a statement by Obama instructing his Health and Human Services secretary to draft rules requiring hospitals that receive Medicare and Medicaid payments to grant all patients the right to designate people who can visit and consult with them at crucial moments."

Show me where ANY patient over the age of 18 already doesnt have this right.

Okay VanceMack, I watched you try and derail this thread for nearly 6 pages now and I've decided to take you up on this challenge. Apparently people in Florida do not have this right:

Hospital changes policy after refusing to let lesbian to visit her dying partner | San Diego Gay & Lesbian News

Jackson Memorial Hospital may be ranked among “America’s Best Hospitals,” but it has a spotty track record in dealing with LGBT issues.

While a lesbian was dying in the hospital, hospital officials denied her partner visitation rights. The decision drew rebuke from gay rights advocates and others concerned about the hospital’s visitation policy.

Today, Lambda Legal, its coalition partners, and officials from Jackson Health System (JHS) released a statement announcing the hospital's improved policies that are more responsive to the needs of the LGBT community. Lamba Legal noted that the new policies still do not provide as much protection as may be needed in critical situations.

Lambda Legal urged Jackson Memorial Hospital to enact a full grievance procedure and also to issue an apology to the Langbehn-Pond family.

It is also not a right for patients living in states which do not recognize gay civil unions or marriage.

Same-Sex Marriage: Developments in the Law - Free Legal Information - Nolo

Marriage-Like Relationships in Other States

California, New Jersey, Nevada, Oregon, and Washington state offer either civil unions or domestic partnerships that are the legal equivalent of marriage in the states that offer them and provide the same rights and responsibilities as marriage, including
:

* rights under family laws, such as annulment, divorce, child custody, child support, alimony, domestic violence, adoption, and property division
* rights to sue for wrongful death, loss of consortium, and under any other tort or law concerning spousal relationships
* medical rights, such as hospital visitation, notification, and durable power of attorney
* family leave benefits
* joint state tax filing, and
* property inheritance when one partner dies without a will.

These rights apply only to couples living in those states who enter into a civil union. But the laws do not give same-sex couples any rights and benefits under federal law. Same-sex couples are not eligible for Social Security benefits, immigration privileges, or the marriage exemption to federal estate, transfer, or gift taxes.

Its irrelevant. Its an appeasement of the gay voting block. It is the equiovalent of telling minorities "look...we know we destroyed your families with welfare...we have no economic opportunities for you, and arent going to do squat to help you improve your life...but hey...we just named the ****tiest and most crime ridden street in your communituy after Martin Luther King Jr. So..pop a cork! lets have a party! And remember...vote early and vote often...vote democrat!"

OK...OK...Im wrong. This is a significant step for homosexuals everywhere. Now...why stop at gays...how about heterosexual boyfriends/girlfriends or live in couples? Dont they too deserve this awesome and significant executive ordered privelege?

And this is just a talking point. What voting block do gays constitute at less than 3% of this country's entire population? No. You're simply wrong. This is simply a move which has been decades in the making and it took Obama to do it.. That you can't seem to realize this is a sign of your partisanship.

Riiiight. And you actually have a DEGREE....

Sure. Get one.. it might help you.

OK..one last time...because frankly...ya bore me to tears...

And one more time because you STILL haven't presented anything that amounts to anything, and because I enjoy making you look foolish.

1) That is not true. Conscious patients cannot do that. Having worked in a hospital, I've seen that first hand. This mandate alters that. Again... fail #1.

2) This is the only thing that folks who dislike Obama know how to do. Attack. The brainwashing is quite telling.

3) Annoyed? Angry? Maybe not, but clueless, certainly. I find it amazing that folks who dislike Obama have lost their ability to think objectively. That is what you are demonstrating. This mandate clearly closes a loophole that CAN be used and has been. But of course, someone who has lost their ability to see things in any but a closed minded way would be unable to see that.

Btw, the Florida case that we are discussing. Vance Mack is, of course, wrong in his assessment. This mandate WOULD have altered that situation. The woman's partner was NOT seeking the ability to make decisions for the woman. She was seeking the ability to SIT with her... and she was denied. Hospitals routinely deny visitation to folks who are NOT family... and those that don't CAN. This mandate eliminates that possibility and closes the loophole. Partisanship prevents some from seeing this.

This is about like passing a law that you won't be pulled over for doing 72 mph on a 70 mph highway.

Obama is grandstanding.
Obama fancies himself the great Fuhrer. Why bother with Congress when you can just tell the country what to do.

Living in a country where most here have no issue with gay marriage--let alone hospital visitation rights--I have to shake my head at the whole nonsense of it all. It's beyond me why some have a problem with this.

While I don't think it's a widespread issue or problem, there is no doubt there have been some incidences where homosexual couples were denied the right to be together in a time of need. Those who want to deny this right should feel ashamed of themselves. Why do you feel this way? It is because you hate homosexuality and feel they should have NO rights as people? Or is it because you're so partisan, you have to go against everything Obama does? Please make me understand because it's not registering.

I think it's all of the above.

It's a step in that direction without saying it is. Besides, his word is worthless. He's blatantly lied to the American people more times than Willie Mays was an All-Star.

Oh brother. Yet another person who makes cursory allegations. *yawn*

Oh brother. Yet another person who makes cursory allegations. *yawn*

Please. I'm not doing the homework for you. If you don't know Obama's lied more times than The Beatles sat atop the charts, then you haven't been paying attention.

Also, I belong to neither party. I just call it as I see it.

I did the homework. I searched extensively. My research shows that Obama hasn't lied. So you are wrong.

Now, if you think otherwise, you have to get off your ass and prove your assertions like you should have in the first place.

There should be a web page that just says "because I say so" in big letters that people like him can cite, with a link.

Please stop trying to divert this thread. It isn't about Obama's alleged lies, it's about an EO regarding gay partners.

I don't have to prove anything. I could, but I'm not going to be the one to get your head out of the clouds.

Do the research yourself.

BTW, I'm not a repub, so I have no incentive to spew canards.

Have a nice day.

I don't have to prove anything.

Well yes, you do.

I could, but I'm not going to be the one to get your head out of the clouds.

Heard on a playground: "I could jump 10 feet high, if I wanted to. I just don't feel like it."

Like I said, I did. It revealed that you are completely full of crap.

Sigh...

did you READ the article? Did you READ the Exec order? Do you realize that the EO WILL NOT CHANGE A THING with regard to incapacitated people and visitation rights?

Whatever...you guys keep patting each other on the back and giving each other high fives...and keep on pretending this wasnt more than a worthless publicitity stunt.

The designated visitors should have the same rights that immediate family members now enjoy"

That Florida case would NOT be altered. Kinda TOUGH for a comatose patient to make that designation, isnt it? And where they ALREADY EXIST, they already have legal standing. In a private hosptial or a non-medicare hospital this is worthless. The article ALSO stated that the administration had been taking hits because the gay community had been critical of them for not acting fast enough. So...low poll numbers...low support...do something WORTHLESS and watch people line up to herald the triumph.

Oh...wait...it gets better...the actual declaration..."may not deny visitation and consultation privileges on the basis of race, color, national origin, religion, sex, sexual orientation, gender identity or disability"...And hospitals did this? Hospitals denied the visitation because the partner was gay?
