Gay Marriage Fails to get on California Ballot

Actually if you want to get technical is the way we do business in this country us the "Will of the people" not activist judges from the bench...If you don't like our system of law maybe you should move to China and try theirs......

The so called " Will of the People" gets knocked down all the time like in the case of the anti miscegenation laws.

Gay couples are projected to spend $684 million on flowers, cakes, hotels, photographers and other wedding services over the next three years - so long as voters don't put a halt to the same-sex marriage spree, according to a study by the Williams Institute at University of California, Los Angeles School of Law.

Don't bother giving me that "activist judge" line, college boy. You know full well that people only use it when they see a court decision go the wrong way.

This ain't a democracy. It never has been, never will be. Plenty of the most important changes made in the history of our nation have been against "the will of the people."
 
What about the Contracts Clause of the U.S. Constitution?

"No State shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility."

Does legal marriage require a legal contract?

Making simple, straightforward arguments well-rooted in Constitutional principles won't score you any points with the bigots.
 
As you well know, someone has to petition the Court to hear a case before they can render a decision, and plenty of times they refuse to hear a case for a variety of reasons.

Yeah in the case because it is solid law.............

Strip all marriage benefits from the tax codes. Disentangle the sacrament of marriage from civil matters altogether. :2razz:

I don't know how long it will to repeal DOMA. But think about it at least people are talking about it. And when DOMA was signed not even one State had State recognized gay marriage. Now a few do.

I personally think its good for the government ro support marriage between a man and a woman and give incentives to do so because of the children involved.......
 
Marriage is not a right.....Its a privilege.........Why do you think you have to get a license?

Wrong. People v. Loving recognized marriage as a right.

Regardless...the Supreme Court has long held that privileges cannot be denied in a discriminatory manner either....so you lose on either grounds.

Gay is not a race, sorry. It's ludicrous to make gay people a "minority" group. Where you prefer to stick it does not matter to me, but it also doesn't qualify you as a minority either. It's insulting to actual minorities.
