Gay Marriage Fails to get on California Ballot

Sad they have to try and get the court system to override the 32nd time in a row gay marriage failed to pass a popular vote instead of accepting the will of the people.

Do you think it was sad when the court overturned segregation?

The CA ballot initiative system has been screwed up for years. The will of the people are the Governor and State Reps.
 
I'll never understand this. If that's what two people wanna do, let em. Not as if they're forcing you to be gay.

Yeah but why stop at two.........How about 3 or 4, 5 or 6 and while your at it let relatives marry in non sexual relationships....Lets have one big happy marriage in this country........:rofl
 
Should blacks have accepted the rulings of votes and courts pre-Civil Rights era? I mean, the will of the people was against them....

Its not the same....Blacks are a race.....Gays are a class of people defined by their sexual preference.........

I am glad to see California do the right thing for once.............

It certainly does take people time to realize that they may be, yes. But you know, if the definition of bigotry is denying rights to another, then this certainly fits.

I mean, I know you and others may justify it by saying you don't want change, but the end result is the same. I know you obviously don't see it as bigotry, but it certainly has the same effect. A victim of your views is discriminated against no matter what.


Yes... but the court's job is to interpret the law and the Constitution. If the right to gay marriage is in neither (which is what I believe to be the case) then they are irrelevant to this.

It all depends on whether you think marriage is a right and whether gays are "people". If you agree that they are "people" then they should be given 14th amendment rights against discrimination just like all other people.

It's really not that hard of an argument to make; it's kind of obvious, actually. It's those who don't want it who seem to be looking for loopholes.

Why is it a privilege? Marriage has been around forever and in actuality is nothing more than an invention of religious institutions. So if the government can't regulate mass. Why should they regulate marriage?

If the SCOTUS disagrees with me then how can there be a federal law called a (DOMA ) Defense of Marriage Act, signed by "Slick Willie" Clinton and approved by over 80 senators stating marriage is a union between a man and a woman?
 
How about veterans' benefits and services?? Do they bother you?

You know, even if I assume that this failure is "the will of the people," I'm really sick and tired of people telling me that "the will of the people" is sacrosanct when "the will of the people" is bigotry.

There's a reason we live in a representative republic, and have law, and courts.

People are fickle.

We elect leaders to make hard choices.

Our problem isn't that our leaders make those hard choices and get kicked out of office, it's that our leaders keep schmoozing us in order to keep bleeding us in exchange for favors from their masters.

Last I checked the DOMA had not come before the SCOTUS.

BTW President Bill Clinton now considers signing the DOMA a bad decision.

Actually if you want to get technical is the way we do business in this country us the "Will of the people" not activist judges from the bench...If you don't like our system of law maybe you should move to China and try theirs......
