DALLAS, Feb 16 (Reuters) - Texas and several national industry groups on Tuesday filed separate petitions in federal court challenging the government's authority to regulate U.S. greenhouse gas emissions.

Texas, which leads U.S. states in carbon dioxide emissions due to its heavy concentration of oil refining and other industries, will see a major impact if U.S. mandatory emissions reductions take effect.

In December, the Environmental Protection Agency ruled that greenhouse gases like carbon dioxide endanger human health, opening the door for the agency to issue mandatory regulations to reduce them.

Texas said it had filed a petition for review challenging the EPA's "endangerment finding" with the U.S. Court of Appeals for the D.C. Circuit. Texas has also asked the EPA to reconsider its ruling.

"The EPA's misguided plan paints a big target on the backs of Texas agriculture and energy producers and the hundreds of thousands of Texans they employ," Texas Gov. Rick Perry said.

I think this is a long time over do to put this nonsense to the bed, now there is so much evidence showing what I and many others have been saying for years about the whole Global Warming HOAX it should be easy to take this as far as the Supreme Court and get a ruling.

The story that came out not too man days ago said that the CO2 level was pretty much the same today a it was 150 years ago before cars and trucks took over from the horse and buggy.

One thing I have never heard argued or challenged is the claim that raising beef is contributing to green house gases.

I believe the stories I heard of the American Bison put them at numbers that far exceeded our current levels of raising beef by millions and millions and yet it didn't cause any problems did it.

I hope they are successful and other States get guts enough to create a Tsunami of protests until the HOAX is put to death for ever.

Are there things we can do better in taking care of the air and to stop pollution? Hell yes but it doesn't have to be done with fear and lies and cost a fortune.

It just takes logic, common sense, and a little thought and education. If done right without raising taxes it could create jobs. Obama and the false environmentalism they are pushing is of no earthy help.

This will be an interesting case. EPA took the first steps toward regulating such gases based on a Supreme Court ruling. Now, this case could get into details as to how such regulation should occur. If Texas et al., is seeking to rule that the EPA lacks regulatory authority concerning greenhouse gases, I doubt that such a case will prevail. If Texas et. al., is seeking to define how the regulatory process should work, Texas' legal prospects will probably be better.

The EPA should be abolished and replaced with a far less powerful entity.

The EPA is over burdensome, and over reaching. You can protect people and not destroy jobs, and economic growth.

How about the ramp agent who tested out the de-icing truck by spraying glycol all over some nearby grass?

The guys who were using discarded jet fuel as a weed killer on the ramp?

(aviation examples as that is my field)

Heavy fines. Overreaching?

edit: Over the course of one year, a coal plant spits out more uranium than a nuclear plant. Except a nuclear plant puts it into a nice, compact, solid rod. Coal plants shove it into the atmosphere.

This practice, I think, should end.

Whatever happens in this case, it will have absolutely nothing to do with whether or not global warming is a hoax, so don't bother casting it in those terms. This sounds like a question of admin law (which I don't know dick about), so I've got nothing particularly useful to add.

That is how I first read of it too. I think, though, it is very easy to cast it in the light of it being that global warming is real or not. To me it sounds like Texas and the various other industry groups that filled this petition do not like the new EPA rules, rather than to disprove global warming.
 
While going throught the courts is a means of forestalling the process, the real problem is that we need to kick our congressmen in the ass to pass legislation preventing the EPA from writing and enforcing regulations on CO2.

Before ANY government agency is tasked with monitoring CO2, it must be determined that CO2 actually causes harm.

This has not been shown to date.

Given that the people people promoting that silly AGW theory are now known to be hoaxers, there's no reason to worry about CO2 at all.
