Law to Curb Lobbying Sends It Underground

Re: Regulate us lobbyists? No problem....

What I don't understand is what the limits are for what speech is protected under the first amendment, and to what extent. Is an armband "speech"? Can an advertiser lie about his product under the first? Can I say "I saw Crunch ****ing a goat" without consequence? If I make a parody of a Disney movie, can Disney sue me for copyright infringement, or are parodies covered? None of these questions are answered in the constitution.

Well, one must have some common sense, don't you think?

The constitution isn't about covering every little tiny aspect of your life. It's about how our government is structured and limited in intruding on your private life.... you obviously didn't read it or you would know these things.

So what is the constitutional answers to the situations I posted?

Re: Regulate us lobbyists? No problem....

Read the constitution and then tell me.

The only relevant part is "congress shall make no law... abridging the freedom of speech". The fourteenth extends this protection further than just congress. I can't think of any other relevent passage. However, "congress shall make no law abridging freedom of speech" is vague in this case because it leaves unclear such as:

1. Is non-verbal communication such as armbands "speech"?
2. Is advertisement considered speech?
3. Is fraud still covered by free speech?
4. Is libel or slander still covered under free speech?
5. If my statement could easily lead to harm of others is it still covered?
6. Are parodies free speech, or do they fall afoul of copyright laws?

Yes to all. Of course I have the right to sue your silly ass in civil court for slander and libel, and if you defraud me I can report it and have you busted....

But that's infringing my freedom of speech!

No, that is making you responsible for your freedom of speech.... see the difference?

Like I said, use common sense.

No, it is an infringement on my freedom of speech. And are armbands covered as speech?

You're going to get nothing out of this other than a few more links to the constitution and a promise that "it's in there if you just READ!"

Funny enough, I keep one of those pocket copies of the constitution on my computer desk.

See post 26.

Yes, and so is burning the US. flag.

Some people would disagree on those two for various reasons, and consider their reasons completely constitutional.

So if you consider an armband protected speech and someone else doesn't, are you going to shoot the judge who rules they aren't?

Which, of course, is why it is open to interpretation and why we have a Supreme court whose job is to settle differences in interpretation.

"promote the general welfare"... what does that mean? Does everyone agree?

"right to bear arms shall not be abridged" how about that one? Can I bear RPGs in case you p** me off? How about a few surface to air missiles, would that make you nervous?

You were the one saying you'd want to shoot judges, I'm curious at to the limits here.
