A jury on Wednesday found that the maker of Louisville Slugger baseball bats failed to adequately warn about the dangers the product can pose, awarding a family $850,000 for the 2003 death of their son in a baseball game.

The family of Brandon Patch argued that aluminum baseball bats are dangerous because they cause the baseball to travel at a greater speed. They contended that their 18-year-old son did not have enough time to react to the ball being struck before it hit him in the head while he was pitching in an American Legion baseball game in Helena in 2003.

This is ridiculous. People want to complain about there being zero tolerance policies and such; but things like this are where they're born from. The pitch was hit straight back at the pitcher. It's a low probability event and very rare to result in death. But it's also one of the greatest dangers to a pitcher on the mound. Wooden or metal, that ball is traveling fast and the reaction time is low. BS lawsuits which result in nanny state policies and irrational zero-tolerance rules.

I'm sorry for the parent's loss, it sucks. But this is an extremely unlikely event, not zero but unlikely. The dice just rolled badly on this one for them. That's how you have to take this. There's no fault on the damned bat company's part. Just a freak accident.

I think humans are quickly becoming dumber.

The parents of this boy, ****ing idiots. The jury, ****ing retarded. They need to be bitch slapped back to reality.

What in the ****ing hell were they thinking? The bat wasn't defective but it didn't have an adequate warning label? Jesus ****ing christ! Do we really need to warn people that if someone hits a ball with the bat that the ****ing ball is going to FLY THROUGH THE ****ING AIR AT A HIGH SPEED???!! Seriously?? Was their 18 year old, baseball playing son that ****ing retarded that he wasn't aware what happens when he puts one over the plate?!

And if there WAS a warning label on it, would that warning label have made their son move any faster and avoid the ball? Seriously? A sticker on a bat would have made him dodge the ball faster? That's their ****ing reasoning for their dumbass decision?

A lawyer is just the tool of the lawsuit. Many people like to say that we are a "nation of laws". Well if we are then we need some of the tools of law and one of those tools are lawyers.

If you want to blame anyone blame the judges and the juries not the lawyers.
 
American's have lost that ability to understand reality. We as a whole seem afraid of pain, suffering and loss. And this is preyed upon by dirtbag lawyers and estrogen loaded juries that put emotion before common sense.

**** HAPPENS. And it sucks, life sucks. This lawsuit will do nothing to save anyone, make life "safer" just enriched some lawyers and costs some working stiffs at the bat factory to lose their jobs.

I disagree. The lawyer is just as much to blame as the judge and jury are. Its like arguing don't blame the person who knowingly buys stolen property. The lawyer,judge and the jury are all equally guilty. Nobody puts a gun to the lawyer's head telling him to do this lawsuit. There is this word called "no", the ambulance chaser could have used it. As far as I know there is no law saying a lawyer must take every case that walks into his office.

What can I say, except that this decision was pretty batty, but what can you expect from judges who don't have the balls to support the Constitution? We need an umpire here - SCOTUS. This may have gotten to first base, but I don't expect it to be making it to home plate. Definitely a bad call here. Instant replay, anybody? :mrgreen:

I only quote you because for the most part today in children's sports everyone is a hero and everyone gets a trophy and just read a few days ago that Parents are shunned for cheering for their child because it might hurt another childs feelings.
I believe the outrage at this and awards like it are pretty much universal unless you lost a child in some freak accident, at which point you just have to blame someone for it.
Having played little league as a pitcher I have been hit by the ball in a most unpleasant region and in the face. It happens, hell I broke most of my fingers my nose, right leg, and got a hernia playing football and the only getting even I wanted was with the other team or the guy who did it. Children are and for have been raised like they were delicate Crystal and they have no concept of what is now called manning up. Their parents are the same and have to have someone to blame and make then pay as if life has no risks and personal responsibility no longer exists.
Tort reform is something that will come on the glorious gay when pigs fly, because trial lawyers donate huge sums to your mostly crooked politicians who is more interested in reelection than anything resembling fairness unless that fairness is heavily in their favor.
