S. Ossetia is sovereign Georgian territory try again.
In accordance with article 72 of the Constitution of the USSR “the decision on seceding from the USSR must be adopted by the free will of the peoples of the Union republic by referendum (popular vote).
In the Federal Republic, which has in its composition autonomous republics, autonomous regions and autonomous districts, the referendum is conducted separately for each of autonomy. The peoples of the autonomous republics and autonomous entities retain the right to decide independently whether to remain in the USSR or the seceding Union republic, as well as to raise the question of their legal status.”
Georgia: 26 May 1990 – declaration of sovereignty; 9 April 1991 – declaration of independence; 26 December – independence de jure.
S.Ossetia: 20 September 1990 – declaration of sovereignty; 1 September 1991 – a decision to become part of Russian Federation; 19 January 1992 – referendum on a) independence, b) part of the Russian Federation – 98% voted “yes” for both; 29 May 1992 – declaration of independence.
As anyone can see, S.Ossetians followed the law to the letter.
Them being there without the approval of the Georgian government is an act of war.

On June 24 1992, a quadripartite
Russian-Georgian-Ossetian (North and South Ossetia) Sochi agreement was signed putting an end to Georgian-Abkhasian and Georgian-Ossetian wars. On July 14 1992
mixed Russian-Georgian-Ossetian peacekeeping force entered South Ossetia.
Georgia didn't attack they defended themselves from S. Ossettian Russian backed terrorist attacks. Try again.
In
1917 Georgia attempted to annex Southern part of Ossetia that led to few armed conflicts.
In
1920 Georgia once again invaded Ossetia killing 18 000 Ossetians and displacing 50 000 into its Northern part.
In
1922 Stalin divided Ossetia and included its Southern part into Georgia against the will of Ossetians.
In
1939 Ossetian written language was changed onto Georgian alphabet; and Ossetian schools were transferred onto Georgian language.
On the
23 November 1989 Georgian nationalists (30 to 60 000) led by future Georgian president Zviad Gamsakhurdia attempted to take Tshinval (capital of S.Ossetia). As a result 5000 Ossetians were killed, 400 injured, 2000 displaced and their homes were destroyed.
On the night of
5-6 of January 1991 Georgian government moved the units of the police and National Guard into the capital of South Ossetia; they began searches, arrests, looting, killing of Ossetians, burning their houses. In these circumstances, the Ossetian side was forced to take measures to defend itself. Defense squad managed to oust Georgian forces from Tskhinvali, after which the latter started punitive actions against the rural areas of South Ossetia.
On the
1 of February 1991 Georgians turned off the electric supply to S.Ossetia causing numerous deaths especially among elderly, newborn and sick.
In
February of 1992 Georgian started indiscriminate mass bombardment of S.Ossetian capital that continued
until 13 of July 1992.
On the
20 of May 1992 Georgians stopped and shot at point-blank column of vehicles carrying refugees from the besieged Tskhinvali: women, elderly and children. 36 people were killed. At a separate location Georgian forces buried alive 12 Ossetians.
Between 1989 and 1992 more than 3000 Ossetian CIVILIANS were killed, 100 Ossetian viliages were burned and 40 000 had to move to Russia.
