So would waving a gun around in a bar be okay even though it scares the **** out patrons?
Beyond what Rev stated, many states have specific laws directly dealing with brandishing a weapon. For example, my state:
"Virginia Code
18.2-282.
It shall be unlawful for any person to point, hold or brandish any firearm or any air or gas operated weapon or any object similar in appearance, whether capable of being fired or not, in such manner as to reasonably induce fear in the mind of another or hold a firearm or any air or gas operated weapon in a public place in such a manner as to reasonably induce fear in the mind of another of being shot or injured. However, this section shall not apply to any person engaged in excusable or justifiable self-defense."
If you're brandishing your gun around then you're in violation of that law and could suffer consequences, the least of which would likely mean your concealed carry permit would be gone.
However, you can't just say "because a gun scares me it should be illegal".
Should we make black people illegal if some little old white lady born in the south and raised a bit racist was "afraid" of the large black man at the bar.
To copy something from George Carlin, shall we ban people with big hands? You can strangle someone with some big freaking hands. Perhaps we should ban them if someone's afraid of being strangled.
Some people are afraid of enclosed spaces. Should we severely cut back on the amount of people allowed in bars now to make sure we will never cause a clostraphobic person from being afraid?
Black belt key chain on a guys keys? Shall we prevent people that have martial arts training from bars or from making it known in any way in bars because it may scare people? How about a pocket knife? If you have a leatherman or a swiss army on you and pull it out at any point to move it from pocket to pocket and someones afraid of it, boop, we need to ban them.
That just doesn't make sense.
There's things that make sense in regards to legality. Brandishing your weapon when not in a self-defense situation is one of them. Saying you can't have it is not.
Its not going to be fun for the bar keeper sweeping bodies from the bar and patching up built holes in the walls.
People are barded from driving drunk. but not for having a gun wile drunk grate plain.
Another day for liberty over logic.
Well why can't I wear it on my hip cowboy style? That is just a restriction of my rights:2razz:
Did you even read the OP or just saw some basic words and went instantly into an emotional response.
Sweeping bodies from the bar? Wow, really. Did you work for George Bush's administration in PR with that kind of huge hyperbole.
And where...show me ANYWHERE...where people are saying individuals should be allowed to be drunk with a gun. The law specifically states they can't drink while they have a gun on concealed. Now,
could someone do it? Sure. Someone
could also drive drunk. Yet we don't ban cars.
