Terminally ill Lockerbie bomber released

Nope, you've simply engaged in purposeless repetition of an irrelevant statement about his legal conviction without actual discussion of the nature of his trial or the disputes related to his trial. If this were a True Debate, you would have long since lost, and even the casual reader of this thread can quite easily see that you're not faring especially well.
A true debate, a false debate, any kind of debate and you'd still be falsely accusing me of not saying something that I clearly said, and just quoted and put it right in your face.
I would make the conclusion that you are deliberately trying to dodge the acceptance that your fleet was just destroyed and that you'll have to return to planet Agna with no achievements at all.
If #2 was a failure, it was because #1 was a failure also. You never made any particularly sound claim to begin with, so there was really no need to issue a sound rebuttal. All you did was claim that Megrahi was guilty merely by virtue of his legal conviction and ignore the contentions that had arisen about the nature and alleged deficiencies of his trial. You continue to do so even now. :shrug:
#1 can't be a failure by definition, and even if we are to go blunt and assume that it is a failure it is because #2 had rudely taken #1's role without even asking for a permission.

No, that's merely a fallacy bred by your apparent confusion. If I'd merely mentioned that there was a complaint by a UN official without offering further elaboration, you might have a point. However, I instead offered detailed criticisms of alleged deficiencies in Megrahi's trial that you chose not to respond to. Their source wasn't even relevant to their validity.

If there was no legitimate risk of him engaging in violent or threatening actions, then he perhaps should be, especially if any trial would simply result in acquittal anyway. In the U.S., we have a Constitutional prohibition of "double jeopardy." I know that you unfortunately don't live in a democratic country with a Constitution, so you'd perhaps be unaware of this. ;)

But one that is out of our hands.

The Scots had their reasons for his release, I regretfully and strongly disagree.

Though I do want to add McCaskill looked good on CNN offering his reasons for what I think is a perverted decision.
 
The Etic Reality on whether he committed the crime or not is not relevant to this thread.

Whether or not the Criminal Justice System prosecuted the case properly is not relevant to this thread.

Whether or not a "majority" of the families of the victims believe in his guilt or innocence and whether or not a "majority" think he should die with his relatives are not relevant to this thread.

What is relevant is whether it is appropriate to free someone dully convicted of a crime at this level of magnitude and the reasoning behind it.

I believe the reasoning behind it was that the Scottish and Westminster governments thought that Mehrahi's appeal would exonerate him post-humanously.

There would then be outrage that an innocent man had died in jail as well as fresh demands for a wide ranging investigation into the Lockerbie bombing, that would be politically inconvenient to say the least. By forcing Megrahi to drop his appeal this has been avoided. I do not believe this is necessarily the "correct" thing to do, I even called it a sham earlier, however I am happy that a man who I do not believe was ever proven to be involved in this crime will not die in jail.

I am frustrated that those baying for blood have been unprepared to look at the case in the smallest bit of depth, and have instead generally resorted to insults and emotional blackmail.

By use of such patronage, the UK royal family is able to form close links with influential persons in Scottish politics and with the Scottish churches.

Therefore Prince Andrew has all the connections anyone would ever need to set up a Libyan oil deals for Scottish justice "compassionate release" for the Lockerbie bomber.

Indeed, Colonel Gaddafi has publicly thanked Prince Andrew for arranging the release of Megrahi.

So Peter Mandelson may claim to know nothing of any such deal but he certainly appointed the right person, Prince Andrew, to set such a deal up and it looks like that is exactly what has happened. :rolleyes:

Therefore whereas it may well be the case that Kenny MacAskill has not personally profited from Libyan oil deal money, it is entirely possible that some back channel deal involving third party donations to one or more of the Church of Scotland's worthy causes has bought pro-compassionate-release spiritual advice from the Church of Scotland clerics to Kenny MacAskill and it may be it is those who interpret MacAskill's Christian faith for him who were the ones who have convinced him that compassionate release was the thing to do in Megrahi's case.

Certainly, the church is always short of money and certainly that is how Arab monarchs and dictators often operate in their own countries - by funding Islamic programmes and sometimes even getting the Islamic clerics to put out pro-jehadi messages when they wish to incite terrorist wars by proxy fought by the likes of Al Qaeda but in a plausibly deniable way which is not easily identified directly as being ordered by the monarch or dictator concerned.

So supporting terrorism in this modest way has begun in European Christian churches as bought by Arab or African oil money. What is next?

Are we going to see Libyan or other oil money funding Christian crusader suicide bombers, bought and paid for by oil deal money?

It happened in the Arab world and it could happen here. The release of this terrorist is just the start unless we get wise to what this oil money in the wrong hands is buying - a terrorist war against our values of freedom and democracy and in favour of monarchy and dictatorship.

Statements from Gaddafi's son provide more evidence that the release has been demanded as the price of doing oil deal business with Gaddafi.

And about his release, it seemed that if they were to go by the law at the moment, there might have been no choice in releasing him. From what I understood of a BBC interview where they were discussing about how there was no political upside to the release, someone mentioned that there was a law in place (came into force in 04 or 05 I think, I can't remember) for releasing prisoners with terminal disease who had less than three months left to live. What I did not get from that interview is that if this provided the option to release the person on compassionate grounds or if someone who fulfilled these conditions would have to be released. I'll try and dig up on this.

By "we", I did actually mean Scotland. And I see no reason for us to try and justify our actions by looking to the actions of a murderer(which I'm personally not convinced Megrahi actully is). He showed them no mercy, so we should so him no mercy? How exactly do two wrongs make a right?

Yeah, I guess it's weird for you.
Many nations outside of Scotland believe that criminals need to be punished, though.
But what do those nations know?
Onwards Scottish justice, show mercy for the mass-murdering terrorist.
 
Okay lets get some things straight.

As a principle, yes life means life according to the local justice system. In the US it is life, where as elsewhere it is 20ish years.. that is how the laws are, and no amount of bitching can change that. But also as a principle there are methods in all justice systems to get early release based on certain criteria and like it or not this man met those criteria in Scotland. There is NO law anywhere that forbids the releasing of convicted terrorists or even child predators, not even in the US.

But back to this case. The man was convicted based on evidence that since hence, aka after the fact, has been at best been highly questionable and at worst directly wrong or fabricated. There was evidence withheld from the defence team and worse.

We have after the fact learned that the key witness for the prosecution received millions from the US government as payment for his testimony and was living in Australia. We have also after the fact found out that a few hours (17) before the bombing there was a break in at the very luggage handling centre where the supposed bags with bombs was loaded onto the Pam Am jet from supposedly Malta. This information was never given to the defence and was directly held back by the Brits as it would plug huge holes in their whole case. The trace evidence from the bomb itself was also huge problem. At the trial it was pushed as if a certain type of timer by a Swiss company had been used. After the fact it turned out to be false and we now know today that the owner of the Swiss company was offered millions by the FBI to provide false testimony and the testimony used at the trial was one big lie. There are other issues with evidence and time lines and what not that in total makes the result of the trial be put in huge doubt.

2 years ago an independent tribunal recommended the cast to the court of appeals for a suspected miscarriage of justice. Thanks to legal delays this case was delayed and delayed and delayed.. I guess the fact that the man in question was already dying of cancer played into the case, since if it had gone forward, the issues with the case, and the involvement of the UK and US governments would have been put on record and talk about an embarrassment.

Now we wont have an appeal but the evidence will be released and of course the usual right wing talking heads in the US and UK will try to discredit all the evidence, cloud the issue and keep shouting "he was convicted in a court of law" bs. It seems to me that the idea of being wrongly convicted of a crime you have not committed is an alien concept for certain people, who see the world in black and more black when it comes to certain things.

I want to know the truth about the bombing, do you not?

It emerged that the prognosis that Abdel Baset Ali al-Megrahi had a life expectancy of only three months or less was supported by an unnamed doctor who had no expertise in terminal prostate cancer.

The final report on al-Megrahi’s condition which went to Kenny MacAskill was drawn up by Dr Andrew Fraser, director of health and care with the Scottish Prison Service.

The three-month time limit is important because Scottish Prison Service guidance says that compassionate release from prison “may be considered where a prisoner is suffering from a terminal illness and death is likely to occur soon. There are no fixed time limits but life expectancy of less than three months may be considered an appropriate period.”

Prostate cancer is one of the slowest growing cancers. Many people get it and live for years and end up dying of other causes.

One of the most aggressive cancers is brain cancer. Senator Kennedy would have counted his blessings if he had got prostate cancer instead.

I wouldn't be surprised if Megrahi supporters bribed a doctor to say "Dead in three months."

The processes of Scots law are well over-due for revolution. That release was not the same as judicial "compassion" - that was soft in the head, which IS a bad thing from a government.


Megrahi was dying to please Gaddafi.

Kenny MacAskill did not take this decision alone. He cited support from the churches led by former Lord High Commissioners of the Church of Scotland like David Steel and Prince Andrew, the UK's oil deal representative to Libya.


The Scottish legal system has not been independent of the English crown since the Union of the Crowns in1603. For centuries, the judges, courts and prisons in Scotland have taken their orders from just one monarch, that of the Kingdom of Great Britain and more recently that of the United Kingdom. That remains the case today. There is NO Scottish independent legal system Brian.


The only thing which is limp is your political analysis Brian which fails to identify that the Queen's government in Scotland has no entitlement to use the Saltire as an alternative Butcher's Apron by releasing a man convicted of butchering Scots and our friends at Lockerbie.

Dr Fraser’s report, however, also contains a reference to the “opinion” of an unnamed doctor — thought to be a GP — who, says that the report, “dealt with him prior to, during and following the diagnosis of metastatic prostate cancer”.

It adds: “Having seen him during each of these stages, his clinical condition has declined significantly over the last week \. The clinical assessment, therefore, is that a three-month prognosis is now a reasonable estimate for this patient.”

The GP is likely to have worked with Megrahi for some time and also one should note that when a cancer is metastatic, you no longer need a specialist in prostate cancer because it has already spread beyond the prostate.

Moreover the three month estimate is a consensus decision.

Thus this article and the storm over the three month period is sound and fury signifying little.

Only a third of Scots believe the Lockerbie bomber should have been freed from prison last week, a poll commissioned by BBC News has suggested.
The ICM Research survey indicated almost three quarters thought Scotland's reputation was damaged by Abdelbaset Ali al-Megrahi's release.

A random sample of 1,005 adults from across Scotland were questioned by telephone on Wednesday and Thursday. The survey found 60% thought the Scottish Government was wrong to release Megrahi, against 32% of respondents who believed it was the right decision. Of those polled, 57% believed Megrahi should have remained in prison until he died, while 37% thought he should have been released at some point prior to his death. But only 36% thought Scottish Justice Secretary Kenny MacAskill should quit.

Despite Mr MacAskill's insistence to the contrary, more than two thirds of those questioned - 68% - thought the decision was influenced by factors other than Megrahi's health, while only 20% believed it was made purely on compassionate grounds.

Almost three quarters of those polled (74%) said the affair had damaged the standing of the Scottish Government in the eyes of voters, with the same proportion believing the release of Megrahi had damaged Scotland's reputation. Only 11% said it had enhanced the reputation of the country, while 10% said it had made no difference one way or the other.

Scotland's reputation has indeed suffered and the polling data suggests that domestic political repercussions are looming.

Well... we all die at some point.
If cancer doesn't get us, then it's some other illness or injury.
Dying is not exactly a special or unexpected circumstance, I wouldn't think.
I would think that if one is sentenced to life imprisonment, it is to be assumed that one will die in prison. Death is the natural and inevitable final phase of "life", now isn't it?

So I guess this ruling leaves me a little confused as well. :confused:
