Actually, Ive never charged for disorderly conduct. :shock:

Ive transported someone to jail who was being arrested for it, but I was just a transport wagon at that point, an officer working off-duty at the movie theater made the actual arrest.

It was a similar situation to Mr. Gates here too, only it wasn't on his own porch, which makes no difference.

I know how these things work, people don't scream and yell loudly about racism just to hear themselves talk, they do it to draw a crowd, which is why this fool (gates) got arrest for disorderly conduct.

(gate is no longer worth capitalizing his last name).

Or does the officer have the option of observing and deciding if one is disturbing the peace...

This is where we disagree.

I do not feel a complaint is needed to an incident that is witnessed by police.

You think police should be able to make an arrest based upon a citizen complaint without witnessing the actual disturbance.
