We can all have our emotional sentiments, of course, but I think it's problematic when some propose them as serious or legitimate policy perspectives. A pattern of demands for capital punishment is typically the outlet for this emotional reaction, which leads to an effective lynch mob mentality that's ultimately counterproductive. For example, Garland (2007, The Peculiar Forms of American Capital Punishment, Social Research, Vol 74, pp 435-464) notes that:

[T]oday's death penalty is a negative mirror image of a public torture lynching—an inverse institution, a disavowal, calculated to resist and deny any such association. But substantively, many of the same social forces that previously prompted lynchings nowadays prompt capital punishment; many of the same social functions performed by lynching then are performed by capital punishment now; and much the same political structures that permitted lynchings then, enable capital punishment now.

This is often in blatant conflict with rational approaches focused on deterrence of future crimes. As noted, inflicting the death penalty upon rapists provides a perverse incentive for them to murder their victims (and violently resist attempts at police capture) because no greater punishment will exist for them. This isn't a factor immediately considered by the bloodthirsty, which could have the cost of ultimately causing more violent and brutal crimes than those they originally emotionally reacted to.
 
Because we live in a system of law and order and we must respect due process. Unless you want to live like a group savages like this was lord of the flies, you must accept that fact.

IF the man is found guilty then what do you think should happen to him? If they decided to act like Vermont in regard to those who prey on children and give than man a light slap on the wrist will you say justice has been served?

Punishment for various crimes exist to adequately punish those who have broken certain. There is nothing wrong with executions,life in prison and other punishments. Criminals are not hospital patients, they are criminals and therefore should be treated like criminals.

Some of these child molesters do kill their victims and this was before many states started enacted capital punishment for them(which some twits in SC overturned those laws). Seeing the drivel you posted on this thread one has to wonder how you think the kidnapper and attempted child rapist should be punished if he is found guilty.
 
Child rapists are scum. No question.

They are, however, like the rest of us, innocent until proven guilty.

Justin Shine should have a vigorous defense--not because of his rights, but because of everyone else's rights.

One of those trials concluding where he's asked, "is there anything you want to say before we hang you?"

I don't believe in our system of law and order. Its a huge failure on almost every level. "The law" rarely protects anyone. Innocent people arrested have to plea out just to get out of jail. The punishment of those who are guilty rarely has any preventative effect and instead mostly punishes families, children and taxpayers. It is a massive legal industry treadmill having little to do with justice or due process. Due process isn't even relevant in over 90% of cases. Plea out or don't. It certainly doesn't treat people equally. Rather it is a system out of control.

I don't believing it the law-God or the slogans of it. I do believe in jungle justice.

The primary purpose of criminal justice (whether through punishment or rehabilitation), must always focus on rational deterrence theory, and thus create appropriate means of deterring additional crime. Mere emotional whims have the capacity to undermine that purpose.

Not at all. It's a matter of rational deterrence theory, and the same argument pertains to inflicting the death penalty on those who commit single murders; it provides a perverse incentive for such a person to commit additional murders and violently resist attempts at police capture. The fact that some rapists kill their victims anyway has little impact on the argument that a perverse incentive would be provided for all rapists to kill their victims if capital punishment was the penalty for rape.

In whatever manner would have a general effect of deterring kidnapping and rape.
 
Those who rape children are not human, nor do they deserve to be treated as such. Somebody call the Orkin man.

People have often gotten up in arms when I've said that some people need killing, but this is a good example of someone who doesn't deserve to breathe good air or walk around upright.

Perhaps if we make it life in prison without the possiblity of parole for child molesters, it would be MORE of a deterant than the death penalty.

Okay...simple death by hanging for child molestation...we'll even let it be a drop.

For molesting and killing a child, I'd go with slow impalement.

Personally, I was thinking physical and chemical castration followed by probation for life, versus the lethal injection.

Then again, I'm only cruel out of efficiency, not sadism.

Okay, I'm actually not serious about the impalement thing... it's just that the idea of someone willfully molesting and murdering a little child just about drives me out of my mind. It's horrendous.
