He should have gotten executed for doing this and the title should be "Man convicted for deliberately infecting others with HIV".

Phillipe Padieu, a former martial arts instructor, showed no emotion as he was sentenced to 45 years for five of the cases and 25 years for the remaining case. The sentences will run concurrently.

The court was preparing to hear from the women this afternoon during victim impact statements.

Earlier this week, Padieu was found guilty of six counts of aggravated assault with a deadly weapon after a jury determined he had unprotected sex with a half-dozen women without telling them he had tested positive for HIV, the virus that causes AIDS.

"He gave them a death sentence," assistant district attorney Lisa King had told the jury. "He deserves a life sentence."

Scum of the lower earth, this one. While I believe in personal responsibility if you're going to have sex (i.e. the women could/should have insisted the man wear a condom), I believe more strongly still in the concept of full disclosure when it comes to those things that are harmful to others. Hopefully those he infected will be able to live long, full lives despite his selfishness.

If I'm reading this thread correctly, most of you would sentence this guy with the death penalty for his actions.

Given this, what say you about adding "knowingly infecting others with a deadly disease" to our list of crimes punishable by death?

No becuase it is no guarantee of death.

The flu kills tens of thousands of people a year. So if you have the flu and goto work/out anyway and someone that contracted it from you dies would you be under the same consideration. Granted the cases are much different you can see where I am comming from.

Then again I am also against a mandatory death sentence for any crime. I believe it should be an option given to all serious crimes but at the discretion of the convicted.
 
I'm against the death penalty in general, but even if I weren't, I don't agree that this man's actions warrant it. The HIV/AIDS cycle in the body generally plays out over the course of a decade, and these days it's more if you get proper treatment. Modern anti-retrovirals are effective indefinitely, unless a mutation occurs. In any case, there is no guarantee of death so you can't charge him with murder.

You can charge him with criminal negligence, even assault perhaps, but not attempted murder, unless you can prove without a doubt that these people WILL die. (A lot of which is up to their own efforts.)

To my knowledge, most prisons have units where infected people are put... at least most of the maximum security ones.
 
I'm mostly amused at the fact that the DA wasn't happy with 45 years and was pushing for a life sentence.

Yes because he deliberately infected other people with a deadly incurable disease. Everyone knows HIV is deadly and everyone knows its incurable. How is this different than deliberately feeding poisonous mushrooms(some take a week or two to kill someone) or some other poison to someone? Considering the fact he has HIV and has no problem infecting others with HIV he is a risk to the prison guards,prison staff and other people and we the tax payers will have to pay for his treatments to keep him alive.

As long as those diseases are specified then yes. If we do not specify the diseases then some ass hole DA will charge someone who went to work with a cold with attempted murder. Laws that are not specified get abused all the time like the parents who try to charge their daughter's 18 year old boy friend for sleeping with their high school age daughter.
