The 18,000 marriages already performed will remain legal. I just saw this on CNN. I don't have a link yet, but will post one as soon as I can find one.

Prop. 8 upheld by California Supreme Court

The justices uphold the same-sex marriage ban but also rule that the 18,000 gay couples who wed before the November vote will stay married. The decision is sure to spark another ballot box fight.

Reporting from San Francisco -- The California Supreme Court today upheld Proposition 8's ban on same-sex marriage but also ruled that gay couples who wed before the election will continue to be married under state law.

The decision virtually ensures another fight at the ballot box over marriage rights for gays. Gay rights activists say they may ask voters to repeal the marriage ban as early as next year, and opponents have pledged to fight any such effort. Proposition 8 passed with 52% of the vote.

Although the court split 6-1 on the constitutionality of Proposition 8, the justices were unanimous in deciding to keep intact the marriages of as many as 18,000 gay couples who exchanged vows before the election. The marriages began last June, after a 4-3 state high court ruling striking down the marriage ban last May.

This one is headed to the SCOTUS.

I highly doubt it. I think opponents of prop 8 know they have little chance of accomplishing anything through the SCOTUS. The defense of marriage act hasn't been overruled.

more likely, its going back to the 2010 ballot.

I had read somewhere that this was the last stop for Prop 8. -- I don't know the legal technicality.

Interesting because they allowed the 18,000 marriages to stand.

Too much traffic on the CA Court Website to D/L the decision.

How many times do the need to vote on it?

until same sex marriage is legal in California.

given the momentum, and the narrow margin in november, I think theres actually a good chance that it could be reversed in 2010.

I dont understand how the ones that were performed before the vote could've been ruled void because the grandfather clause wouldve came into play. But at least that fight wont have to be fought.

Silly me, I thought the did the first 3 times. :doh

well you thought wrong. but hey...if they really got it right the first three times, then there shouldn't be enough support to get it back on the ballot, huh? :doh

You never know, 4th time lucky ...

Well....if Constitutional rights are subject to a simple majority vote, then it should be on the ballot every year in order to reflect what the will of the majority is.

Views of gay marriage are changing rapidly. The younger generation overwhelmingly approves of gay marriage. It is inevitable.

I think the momentum stops here.

As many as necessary until their agenda is passed.
But then, if it passes, it'll just be at the ballot box again to ban same sex marriages again! and again! and again!

Hopefully, Arnold will get a "60%" threshold passed for changes in the constitution before then. lol, wouldn't that be a riot!

You mean "more" changes in the constitution.

Then, one April day we heard it
Thunder rumbling
One man speaking
Thousands singing ..
Someday we'll be free
I promise you, we'll be free
If not tomorrow
Then the day after that
And the candles in our hands
Will illuminate this land
If not tomorrow
Then the day after that
And the world that gives us pain
That fills our lives with fear
On the day after that
Will disappear
And the war we've fought to win
I promise you, we will win
If not tomorrow
Then the day after that
Or the day after that

yea, that's what I meant.

But either way, will this fight ever end?

Its already ending....gay marriage is inevitable. Just like the history of all discrimination, as the public enlightens....bigotry and discrimination fail.
The younger generation is overwhelmingly in favor of gay marriage and older generations are being educated on the issue as well. The end of the issue is probably only a few years away.
