It's not the government's job to supervise private colleges and the words they write on their diplomas.
If a student studies as a private fruitcake factory using his own money and passes the courses according to the requirements of the head chefs, he can be awarded any degree the college wishes to bestow on him.
All the state of texas has to do is re-word it's hiring requirements for teachers and other positions stating that successful applicants will have degrees from colleges accredited by the state accreditation board.
That's not discrimination, that's merely prudence. The state accreditation board shouldn't have the power to command college curricula, it should merely be the state authority reviewing curricula to ensure that colleges meet the minimum requirements the board feels is essential....and really, there's no reason this function couldn't be served by a private body.
Underwriter's Laboratories provides minimum standards for equipment, certainly colleges could organize their own accreditation board without government interference.
