For nearly six years, Haji Bismullah, an Afghan detainee at Guantánamo Bay, has insisted that he was no terrorist, but had actually fought the Taliban and had later been part of the pro-American Afghan government.

By reviewing government documents, court records and media reports, The Times was able to compile an approximate list of detainees currently at Guantánamo.

Over the weekend, the Bush administration flew him home after a military panel concluded that he “should no longer be deemed an enemy combatant.”

Asked about the panel’s decision, which was not publicly announced and seemed to acknowledge a mistake of grand proportions, a Pentagon spokeswoman said, “Mr. Bismullah was lawfully detained as an enemy combatant based on the information that was available at the time.”

The decision was part of a pattern that has emerged in the closing chapter of the administration. In the last three months, at least 24 detainees have been declared improperly held by courts or a tribunal — or nearly 10 percent of the population at the detention camp in Guantánamo Bay, Cuba, where about 245 men remain.

While hundreds of suspects have been released from the detention camp in the seven years it has been operating, the recent decisions came after the Bush administration said it had reduced the population to the most dangerous terrorists.

I look forward to hearing how Hussein Obama will have a perfect record of dealing with terrorists during war. Perfect detention record from the Dept. of Bubbles and Feathers. Formerly known as the Dept. of Defense.

That without risking more dead American warriors and civilians.
Let's see how fast Hussein Obama closes Gitmo.

Will it get done by the end of his one-term reign?

Are you talking about the terrorists that use schools and Mosques as staging points for attacks?

Are you talking about the terrorists that don't fight wearing uniforms?

Are you talking about the terrorists that use civilians as shields?

Are you talking about the terrorists that drag dead bodies through the streets?

Are you talking about the terrorists that cut off the heads of those they capture? Journalists included?

I want you peaceniks to bring court cases by the hundreds against Bush and his administration. Bring it on if what they've done is illegal (it isn't). Just do it. Try to bring justice for your terrorist buddies.

It's not about "Are these guys bad guys?". It's about following the law and taking the high road and setting an example to the rest of the world.

As we have already seen by the recent decision re: not prosecuting a Gitmo prisoner solely because he was tortured, if we don't abide by the law those bad guys won't get prosecuted.

What's more important to you, beating the snot out of someone because you "think" they're one of the bad guys? Or seeing him lawfully found guilty and sentenced to life in prison, or death?

The high road as set by the ever forward looking Bill Clinton.
He bombed an innocent pill factory and a hillside in Afghanistan.
He set up the program called "Rendition". Sending deep threats to other lands for extreme calisthenics.

That High road?

The one that left a million or so dead in Iraq... half being children.
That high road, the road that was "worth it" and left Saddam Hussein in power... plying and corrupting the UN for billions?

Yo see, enemy combatants should not be tried anywhere until after the war is over. They don't wear uniforms, they hide among civi's, so they are left to the good graces of our military. That's as it should be when we are at war.

But no, leftist busy bodies believe we should treat terrorists as legal threats and in our court system.

I have a funny feeling you have the same disrespect for our military. Those that will be put at greater risk due to you and the pacifists you run with.
