Stay-at-home orders aimed at reducing the spread of coronavirus are now facing legal challenges from residents and state officials alike, alleging that some measures – mostly put in place by Democrats -- go too far while the country gradually moves toward reopening.California alone is facing at least a dozen lawsuits that include claims that the state has unjustly closed down gun shops and religious services, infringed on freedoms of speech and assembly by restricting protests, and one case where a resident alleges that being forced to remain at home constitutes forced detention without due process.


The American people are sick and tired of liberal rhetoric and attacks on individual freedoms including those that may have negative consequences. That is what this country was built on, individual freedom and the right to make your own personal choices that have consequences, good or bad

Here's all it takes to "face a lawsuit": The plaintiff files a complaint.

Here's all it takes to "face a lawsuit" for several months if not a year: The defendant files a motion to dismiss* and the judge denies it.

Facing lawsuits means jack ****. It means even less when the court system has ground to a halt because of COVID issues (kind of ironic given the thread. :lol: ). If you want to know why, read on. If you don't, just trust me.





Now, ignoring technical issues I will ignore, we'll just briefly address the only one relevant to the OP's use of "facing lawsuits" as proof of something substantive: the 12(b)(6) motion to dismiss.

This is that the defendant "fail[ed] to state a claim upon which relief can be granted". Wanna know the standard? The motion must be denied unless, even after assuming every single factual statement made in the complaint is 100% true, the plaintiff would necessarily lose.

If states are facing a lot of lawsuits, all it means is that nobody was stupid enough to file such a suit and/or that no lawyer was stupid enough to take the case. Hence "jack ****"

I like what this CA town is doing...

The City of Atwater has declared itself a “sanctuary city” for all businesses, allowing owners to open despite the state of California’s stay-at-home order amid the coronavirus pandemic.

The Atwater City Council voted on the resolution on Friday afternoon, saying it, “Affirms the city’s commitment to fundamental constitutional rights.”

“This is America. You have the choice. It’s time for the government to stop dictating another month, another three months, six months,” said Atwater Mayor Paul Creighton. “When is it going to end? When everyone is bankrupt?”

Non-profit organizations, such as churches, are also allowed to reopen under the new resolution.

Essentially, they are saying "To hell with the courts. We'll do this our way. You don't like it, take US to court."

Cut off your free money and force you into 100% quarantine and then we'd see how you really feel.

Old people who rarely leave their homes anyway want the shut down to go on forever so they can get freee money they have NO reason to be receiving forever. The shutdown has become nothing but a matter of greed - ie the government stealing money for them - to tens of millions of Americans.

The USA has become a country of thieves. The credit card companies, Paypal, Amazon etc has notified merchants they are well aware of the enormous numbers of people filing false complaints and false chargebacks to try to get products for free. For our business it is extreme. Many times a day now we get calls from people outright lying and in documentable ways. With the government sending people thousands of dollars of free money - regardless of whether they have suffered any economic lose at all - has led people to believe they are entitled to everything free. All they have to do is whine, cry, rant, and demand enough and they think they should get anything they want for free.

It is not without costs. We are constantly raising our prices now to cover theft. The more honest people are victimized by thieves this way, the more people will become thieves themselves. The ME! ME! ME! EVERYONE EXISTS FOR ME!!!" now seems the clear opinion of a majority of Americans.

The decline of the USA - as this is the beginning of the end - is due to a majority of Americans becoming totally amoral or immoral, narcissistic, unjustly claiming self entitlement, and fundamentally lazyass theives.

If what you posted it true, you should 100% self quarantine and never, ever, ever leave your home again. Then you have nothing to whine about. Of course, you'll keep demanding free money from the government, won't you?

But unless you wear a face shield when you go out it means you don't believe 1 word you posted because you knowingly, willingly and deliberately are exposing yourself to be infected in a way you could avoid.

NO ONE really believes their terror talk. Even the experts on TV urging a perpetual shutdown don't believe their own words - noticing that NONE of them wear masks or practice social distancing. But that obvious laughing-at-you is apparently beyond your understanding.

That also means there is no need for me to wear a mask or do social distancing because literally on a legal level I am recognized by the federal government as an "expert" on virus dangers. Therefore, I can neither be infected or infect anyone, just like Dr. Fauci can't.

She got the virus before anything was in place. She found out she had it in late February. I don't know her politics...that isn't something we discuss at work.

At any rate, other people, if you don't believe me, either read the federal rules and some cases OR google motions to dismiss in federal courts, civil cases. A lot of firms now have websites where they post articles about various general legal issues. If you're on the page, you get a window opening that is some admin offering to assist you (aka, trying to get clients).

So if their page on Rule 12 doesn't fully back me up, just ask the admin. If you're feeling rude, you can tell them to eat a bag of dicks before you close the window.

If people are dumb enough to ignore social distancing guidelines and stay away from areas that aren't practicing that, then that isn't anyone else's problem but the ones who made that decision. Apparently the nanny state is supposed to take the place of logic and common sense

Not sure how you were raised but my parents taught me personal responsibility along with logic and common sense which I practice today. What gives anyone the belief that federal bureaucrats will do a better job. Life is about making choices, the left wants to blame someone else for poor personal choices THEY make
