Trump Campaign Sues New York Times Over 2019 Opinion Article

This "opinion" article, in particular, is rather egregious in it's assertion of what the author believed to be facts. It is certainly written to appear to be a factual piece.
Is it in the opinion section? If so, then it cannot be taken as a factual piece. Those are in the other sections of the paper.

It will be interesting for sure since the NYT defense will have to be that they were innocently idiots while explaining why they made claims of facts in the article.
No they dont. They would only have to show that the opinion writer believed what he was writing to be fact. And that is if Trump's team can even show any sort of loss or damage, which is not likely and meet the other factors.

Goldwater could show evidence the journalists went out of their way to lie, including a psychiatric poll as a reason he was not fit for office, despite a psychiatrist warning them that such a poll could not prove/show anything, since true evaluations have to be done in person, face to face, before it was published.

This case has little to no standing and only has any chance if those Trump appointed as judges and a few others show their bias.

The lawsuit says the column, published on March 27, 2019, falsely stated the “campaign had an ‘overarching deal’ with ‘Vladimir Putin’s oligarchy’ to ‘help the campaign against Hillary Clinton’ in exchange for ‘a new pro-Russian foreign policy, starting with relief from … economic sanctions,” Jenna Ellis, senior legal adviser to Donald J. Trump for President, Inc., said in a statement.

“The statements were and are 100 percent false and defamatory. The complaint alleges The Times was aware of the falsity at the time it published them, but did so for the intentional purpose of hurting the campaign, while misleading its own readers in the process,” the statement said.


The lawsuit was filed in New York State Supreme Court.

"stores closing", "companies buying other companies and creating double digit debt in the tune of "$billions".. and the result is destroyed companies, laid off people and a disrupted supply chain that served those closed business and destroyed companies.

We watched the Russian pandering, when Trump trashed our former Presidents, while praising Putin, and went on to denigrate our own American Intelligent Agencies.. and now has damaged severely our Justice Department.

To be libel the opinion piece WRITER has to know it to be false. A vast majority, including the intelligence community believe this to be a truth and not the contrary. Also, Trump is a public figure..

A libel suit isn't about factual statements. Showing a statement to be factual is the primary defense against libel suits.

In this case the author made no attempt to present his opinion as opinion, he stated it as if it was proven fact.

It will be an interesting case. Can a news agency lie it's ass off and present baseless accusations as fact so long as the article is in "opinion"? The NYT seems to think it can.

One thing is for sure, Trump has no qualms fighting the democrats on their level, and he will, as Democrats always do, shop this case around for a sympathetic court.

"Actual malice" was defined in a U.S. Supreme Court case decided in 1988, Hustler v. Falwell. In that case, the court held that certain statements that would otherwise be defamatory were protected by the First Amendment of the United States Constitution.

This meant that public officials could only win a defamation suit when the statement that was made wasn't an honest mistake and was in fact published with the actual intent to harm the public figure. Actual malice only occurs when the person making the statement knew the statement was not true at the time the statement was made or had a reckless disregard for whether it was true or not.

Public officials unlike other people have to overcome a Malice requirement.
this is usually where public officials lawsuits fail.

there is a slim chance given how badly the NYTimes has been covering trump that this very well could meet that requirement.
They are not suing the NY times over an opinion. They are allowed to have an opinion.

What they can't do is maliciously lie and then claim 1st amendment.
The mueller investigation proved there was no evidence of trump colluding or collaborating or anything else with russia.

There was no deal in place this was proven so it could be that the NY times overstepped their bounds.

The problem is this. That the facts are our there already. the mueller report has been published for a while and it pretty much counters everything that this person wrote.
The NY times is playing a political game with the law. From my perspective they ran this as a supposed opinion piece story to get around the libel charges.
to me that seems a bit dubious in nature. More so if the person writing the supposed opinion piece is making claims of fact.

This is going to be an interesting case to see how far papers are allowed to libel people. I also agree that trump has a huge barrier to overcome with the malice requirement.
they person writing it knew that these were false because we already had the information and the NY times itself even reported on it.

He literally takes money from children with cancer and steals from charity. He literally brags about the women he's sexually assaulted. I don't like anyone intentionally lying or twisting the truth to deceive. I am not concerned about making a mistake when speaking. Expecting perfection especially when making speeches about anything and everything like most leaders have to is understandable. Intentionally using a platform such as the media to continually attack someone and mislead the people is propaganda. I guess I need to pick a side and realize that lying is acceptable behavior today.

If the NYT deliberately and maliciously lied, they can be held liable. It will be up to Trump's attorneys to prove that to a jury.

I'm sure he's got a very low chance of winning, especially if he gets one of the many leftist judges that don't really care about the law. But, I'm glad he is taking some action. The Times should be held responsible for making false statements and passing them off as "opinion". That's just BS and they know it. They know they will get away with it, that's why they do it. As usual for the left, the ends justifies the means. We see it all the time from them.

Not really it will test the standard of journalistic integrity in this country. If the courts rule against trump then we know that the media
can pretty much print anything they want no matter how much lying there is and suffer no consequences for it.

If they rule for trump then we know that there is a set standard in journalist integrity and in that they are head accountable for knowingly
printing falsehoods on purpose.
 
The bottom line is this law suit, win, lose or draw, will cost the NYT lots of money for legal fees. Trump has the best lawyers and the Times will need to spend handsomely, just to keep up. The longer this is stretched out, the higher the cost. This law suit is designed to handcuff the NYT, since if the Times continues to show a pattern of fake news behavior, going forward, they will lose $millions in the suit. The crooks are being kept honest.

The irony is Obama and Hillary had a much better relationship with Putin than Trump. Remember the uranium deal under Obama that earned the Clinton Foundation millions of dollar from comrade Putin? What did the Clinton give or owe Putin for all that money? Didn't Hillary and the DNC buy a fake dossier co-authored by their comrades in Russia? And didn't Obama help Putin annex part of Ukraine, but double crossing Ukraine. Putin has Obama first disarm Ukraine, and them not give Ukraine the timely military assistance it had promised. This allows Putin to invade without an injuries. Putin and the DNC, go way back.

The tactic that the Dems have been using is to project their crimes and then blame others, to divert attention from themselves For example, Biden is on record bragging how he did a quid pro quo with Ukraine. The DNC projected this onto Trump and then tried to impeached Trump, for a quid pro quo, as a smoke screen to cover Biden and Obama.

Russian collusion 2.0 must mean there are deeper ties between the DNC and Putin, that are being projected and need to be covered up. Don't forget about the Barr and Durham investigations getting close to indictments.
