    CHICAGO - Former “Empire” actor Jussie Smollett was indicted Tuesday in Chicago by special prosecutor Dan Webb, stemming from the alleged racist and anti-gay attack on him that occurred in January of 2019, a source confirms to FOX 32 News.

    He is due in court February 24.

    Smollett told Chicago police last year that two men physically attacked him and yelled racial and homophobic slurs. But prosecutors insist Smollett faked the racist, anti-gay attack on himself in the hopes that the attention would advance his acting career.


    Smollett said two masked men shouted racial and anti-gay slurs, poured bleach on him, beat him and looped a rope around his neck. He claimed they shouted, "This is MAGA country" - a reference to President Donald Trump's "Make America Great Again" campaign slogan. He asserted that he could see one of the men was white because he could see the skin around his eyes.

    Police said Smollett paid $3,500 to the two men, both of whom are black.

    The men were brothers Abimbola "Abel" and Olabinjo "Ola" Osundairo, and one of them had worked on "Empire." An attorney for them, Gloria Schmidt, has said the brothers agreed to help Smollett because of their friendship with him and the sense that he was helping their careers. They declined to comment.

    Schmidt said in a statement: "The Osundairo brothers were fully prepared to testify in any criminal proceeding in the Jussie Smollett case."

    If I were on the jury, I would totally buy an insanity defense because only someone who freaking nuts would think this would somehow get them a raise even if he had been able to pull it off.

    I suspect a plea deal will be offered/accepted on the (up to 6?) counts of disorderly conduct and he will get a light sentence. IIRC, he was initially facing 13 counts which were mysteriously disappeared.

    Why waste even more money on a trial when the prosecutor could "clear the case" with a guilty plea? The real crime is that the original prosecutor is not facing charges.

    Once prosecutors obtain an indictment, they have to file a motion to dismiss it - with prejudice (if they never want the charges to be brought again) or without it (they can be brought again, within the statute of limitations - and a judge has to grant it, at least in every jurisdiction I've bothered with. Alternately, the defense can file a motion to dismiss arguing that there isn't probable cause on at least one element of the crime based on the GJ transcripts or the application for criminal complaint (two ways to launch a case in state court; federal requires indictment. 6th A.)

    I don't remember much of any reporting on why they were originally dismissed. I do remember Rahm Emmanuel was pissed. It looks like a judge on his own appointed a special prosecutor. I'd be surprised if it was the same judge as granted the other prosecutors first motion to dismiss, since why would he grant a motion to dismiss but then appoint a special prosecutor to go after the charges again. The special prosecutor then disagreed with the original county prosecutors, finding enough evidence to pursue charges.

    (Of course, lack of evidence is only one of many reasons a prosecutor might seek to dismiss a charge).

    Simple: the special prosecutors might want a sentence that the defense doesn't agree to. I don't see much in the way of a viable defense here, but they might simply hope for jury nullification. Can't argue nullification to a jury and the judge orders them to follow instructions, but...the jury can ignore instructions and acquit for any reason.
